933
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA AUTHORIZING THE MAYOR, IN BEHALF OF' SAID CITY
OF' BOZEMAN, TO MAKE .APPLICAT ION TO THE UNITED STATES FOR AN ADVANCE TO AID INFINANC ING ENG INEERING SURVEYS
AND PLANS FOR EXPANSION, EXTENSION AND IMPROVEMENT OF THE SANITARY SEWER SYSTEM .AND SEWAGE TREATMENT FACILI-
TIES OF THE SAID CITY OF BOZl!ID\N. ~
WHEREAS, The City of Bozeman, Montana, herein called the "Applicant", after thorQugh consideration of the
I various aspects of the problem and study of available data, has thereby determined that the construction of
certain public works, generally delJcribed as expansion, extension and improvement of the entire sanitary
sewer system and enlargement of sewage treatment facilities of the said Ci~ of Bozeman is desirable and
in the public interest and, due to continuing growth of the said city, is becoming an urgent need for the
protection of the health, welfare and safety of its citizens; and
WHEREAS, tibder the terms of Public Law 560, 83rd Congress, as amended, the United States of America has
authorized the making of advances to public bodies to aid in financing the cost of engineering and archi-
tectural surveys, designs, plans, working drawings, specifications or other action preliminary to and in
preparation for the construction of public works;
WHEREAS, the Applicant has examined and duly considered such Act and the Applicant considers it to be in
the public interest and to its benefit to file an application under said Act and to authorize other action
in connection therewith;
NOW, THEREFDRE, BE IT RESOLVED BY The City Commission of the City of Bozeman, Montana, the governing body
of said Applicant, as follows:
1. That the construction of said publio works is essential to and is to the best interests of the AppliCB.nt,
and to the end that such public works may be provided as promptly as practicable,
it is desirable that
aotion preliminary to the oonstruction thereof be undertaken immediately;
2. That Howard Erwin, Mayor of the City of Bozeman, Montana be hereby authorized to file in behalf of the
Applicant an application (in form required by the United States and in confo~ity with said Act) for an
advanoe to be made by the United States to the Applioant to aid in defraying the oost of plan prepara-
tion for the above described public works, which shall consist generally of preliminary engineering
work required for cheoking and study of the existing sewerage system, making required surveys to deter-
mine need for enlargement or replaoement of existing trunk sewer lines, making surveys and detennining
needs for extension of the sewerage system to areas within and adjacent to the present limits of the
said City and preparation of a preliminary report and preliminary plans for such proposed public works.
I 3. That i' suoh advance be made, the Applicant shall provide 01' make necessary arrangements to provide
such funds, in addition to the advanoe, as may be required to defray the oost of the plan preparation
of such public works;
4. The said Howard Erwin, Mayor of the City of Bozeman, Montana is hereby authorized to furnish such in-
formation and take such other aotion as may be necessary to enable the Applicant to qualify for the
advance;
5. That the officer designated in the preceding paragraph is hereby designated as the authorized represent-
ative of the Applicant for the purpose of funnishing to the United States suoh information, data,
and
doouments pertaining to the application for an advanoe as may be reqyiredJ and otherwise to ect as the
authorized representative of the Applicant in oonnection with this app~ioation.
6. That oertified copies of this resolution be included 8S part of the applioation for an advance to be
submi tted to the United States.
Passed and adopted by the City Commission at its regular meeting on the 29th day of Ootober, 1958.
