IN TRE CITY 0 F BOZEMAN, COUNT OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING -.AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 3S3 WHEREAS, The City Commission of the City of Bozeman, did on the 22nd day of May, 1957, duly and reg- I ularly pass Commission Resolution No. 839, entitled.. A RESOLUTION OF THE CITY COMMISSION OF Tl1'"E CITY OF' BOZEMAN DECLARING IT TO BE THE INTENTION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 393 OF THE CI1'Y OF' BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROIIBCT ON WEST KOCH STREET FROM SOUTH EIGHTH AVENUE TO SOUTH FIFTEENTH AVENUE ON WEST STORY STREET AND WElT DICKBRSON STREET FROM SOUTH EIGHTH AVENUE TO SOUTH FOURTEENTH AV~UE, ON WEST ALDERSON STREET FROM SOUTH NINTH AVENUE TO SOUTH FOURTEENTH AVENUE, ON SOUTH NINTH AVmUE FROM WEST KOCH STREET TO WEST DICKERSON STREET, AND ON SOUTH TENTH, ELEVENTH, TWELrm, THIRTEENTH AND FOURTEENTH AV1'NUES FmM WEST KOCH STREET TO WEST COLLEGE STREET, SAID PAVEMENT PROJECT TO INCLUDE COM- BINATION CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE AND OTHER WORK INCIDENTAL THERETO. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 26th day of June, 1957, duly pass Commission Resolution No. 846, entitled, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMRRO~T DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 393 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST KOCH STREET FROM SOUTH EIGHTH AVENUE TO SOUTH FIFTEENTH AVENUE ON WEST STORY STREET AND WEST DICKERSON STREET FROM SOUTH EIGHTH AVENUE TO SOUTH FOURTEENTH AVENUE, ON WEST ALDERSON STREET FROM SOUTH NINTHAVENUE TO SOUTH F'OURTEKNTH AVENUE, ON SOUTH NINTH AV,iNUE FROM WEST KOCH STREET TO WEST DICRERSON STREET, AND ON SOUTH TENTH, ELEVENTH~ TWELFI'H, THIRTEENTH AND FOURTEENTH AVENUES FROM WEST KOCH STREET TO WEST COLLEGE STREET, IN SAID CITY Which Commission Resolutions Nos. 839 and 846, passed as aforesaid, are hereby referred to and made a part of this resolution for further partioulars in respeot to the boundaries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assess- ing the cost against the property within said distriot; and WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 839 and 846 have been constructed and completed in aocordance with the terms and conditions of Commission Resolutions Nos. 839 and 846, and the total cost of said improvements so constructed is the sum of Two hundred ei&hty-four Thousand two hundred ninety-three and 88/100, ($284,293.88). I NOW, THEREFORE, Pursuant to the provisions of Sections 5225 to 5277,5 ~d 5485, R. C. M., 1935 ~d amendments thereto, BE IT RESOLVED AND IT IS HEREBY ORDERED BY TEE COMMISSION OF THE CI TY OF BOZEMAN ~ STATE OF MONT ANA, Section 1. That to defray the cost and expense of constructing and making the improvements in said Special Improvement District No. 393, there be, and there is hereby levied and assessed a tax amounting to the sum of Two hundred eighty..four thousand two hundred ninety-three dollars & 88/100, ($284,293.88) upon all the property in said Special Improvement District No. 393, that a particular desoription of each lot and paroel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the owners and the described lots and paroels of land be, and the same are hereby respectively levied and assessed uponand against said described lots and parcels of land to defra.y the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assesSment list, Schedule "A", as required by law; that the payment of said sums shall be made in nineteen installments and the payment of said installments shall extend over a period of eighteen years; that th. payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made. that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 22nd day of October, 1958, at 1,00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. I Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozemen, a notice si~ned by the Clerk of the Commission and stating tha.t a Resolution levying and assessing a special assessment of taxes to defray the cost and expense of constructing and making the im- provements in the said Srecial Improvement District No. 393 is onfile in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adortion of thi.s Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of object- ions and the final adoption of this Resolution Provisionally passed and adopted by the Commission of The City of Bozeman at a regular session there- of held on the 15th day of October, 1958. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The Ci~ of Bozeman held on the 15th day of October, 1958, COlrunission Resolution No. 932 was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 393 in said City, to defray the cost and expense of con- structing and making the improvements within said District, to-wit, Beginning at a point on the west line of South Eighth Avenue which is 150 feet North of the North line of West Koch Street, thence southerly along the West line of South Eighth Avenue to a point 150 feet South of the South line of West Dickerson Street; thence westerly 150 feet south of and parallel to the South 1 ine of West Dicke rson Street to the West line of South Ninth Avenue. thence southerly along the West line of South Ninth Avenue *0 a point 160 feet south of the South line of West Alderson Street; thence westerly 150 feet south of and parallel to the south line of West Alderson Street to a point 143 feet east of the east line of South Tenth Avenue. thence southerly 143 feet east of and parallel to the east line of South Tenth AVenue to the north line of West College Street; thence westerly along the north line of West College Street to a point 123 feet west of the west line of South Four- teenth Avenue; thence northerly 123 feet wewt of and parallel to the west line of South Fourteenth Avenue to a point 140 feet south of the south line of West Koch Street. thence westerly 140 feet south of and parallel to the south line of West Koch Street to the east line of South Fifteenth Avenue. thence northerly along the east line of' South Fifteenth Avenue to a point 140 feet north of the north line of West Koch Street. thence easterly 140 feet north of and parallel to the north line of West Koch Street to the east line of South Thirteenth Avenue; thence northerly along the east line of South Thirteenth Avenue to a point 150 feet north of the north line of West Koch Street. thence easterly 150 feet north of and parallel to the north line of West Koch Street to the point of beginning. I That, said Commission Resolution No. 932 is now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday, the 22nd aay of October, 1958, at 1,00 o(clock P.M., of said day at the regular session of the said Commission of The City of Bozeman, at the Co~~ission Room, in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 932, and the levying of said assessment, and that Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 839, declaring it to be the intention of the Commission to create Special Improvement District No. 393, and Commission Resolution No. 84~, creating Special Improvement District No. 393, for constructing and making the improvements therein.
