HomeMy WebLinkAbout4-16-07 Report compiled on April 5, 2007 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Jody Sanford, Senior Planner SUBJECT: Billion-Norton Growth Policy Amendment Application #P-06065 ADOPTING RESOLUTION MEETING DATE: Monday, April 16, 2007 CONSENT AGENDA RECOMMENDATION: The City Commission adopts this resolution as presented. BACKGROUND: On February 12, 2007, the Bozeman City Commission voted 4-0 to approve this growth policy amendment application, as amended by the Commission, to change the land use designation for 19.0140 acres from Residential to Community Commercial. The applicants have fulfilled the contingencies attached to their approval. Staff is now presenting an adopting resolution to formally adopt this amendment. This amendment will be effective immediately upon Commission adoption of the resolution. UNRESOLVED ISSUES: There are no unresolved issues at this time. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues, along with increased costs to deliver municipal services to the property, when the property is developed. APPROVED BY: Andrew Epple, Planning Director Chris Kukulski, City Manager ATTACHMENTS: City Commission Resolution #4014 Exhibit 25 1 RESOLUTION NO. 4014 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE GROWTH POLICY LAND USE DESIGNATION, AS SHOWN ON THE FUTURE LAND USE MAP IN THE BOZEMAN 2020 COMMUNITY PLAN, FROM RESIDENTIAL TO COMMUNITY COMMERCIAL FOR 19.0140 ACRES, AS ALLOWED BY SECTION 76-1-604(3)(A), MONTANA CODE ANNOTATED (MCA) AND SECTION 2.4, BOZEMAN 2020 COMMUNITY PLAN. WHEREAS, the proposed growth policy amendment to amend the growth policy land use designation, as shown on the Future Land Use Map in the Bozeman 2020 Community Plan, from Residential to Community Commercial for 19.0140 acres has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Planning Board held a public hearing on January 17, 2007, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the Bozeman Planning Board voted 5 in favor and 1 against to forward to the Bozeman City Commission an recommendation of approval for said growth policy amendment; and WHEREAS, after proper notice, the City Commission held its public hearing on February 12, 2007, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the City Commission has reviewed and considered the four growth policy amendment criteria established in Section 2.4.1 of the Bozeman 2020 Community Plan, and found that if the growth policy amendment was limited to approximately 20 acres, it would be in compliance with the four criteria; and 26 2 NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That upon a vote of 4-0, the growth policy land use designation for the following-described properties is hereby designated as Community Commercial: That part of the Northeast Quarter of the Southeast Quarter of Section 9, Township 2 South, Range 5 East of PMM, City of Bozeman, Gallatin County, Montana, described as follows: Beginning at the southeast corner of said Northeast Quarter of the Southeast Quarter; thence westerly 268° 56’ 49”, assumed azimuth from north, 1042.66 feet along the south line of said Northeast Quarter of the Southeast Quarter; thence northeasterly 025° 40’ 18” azimuth 187.75 feet along the centerline of Baxter Creek; thence northerly 354° 46” 52” azimuth 258.08 feet along said centerline; thence northerly 007° 18” 40” azimuth 313.54 feet along said centerline; thence easterly 088° 51’ 56” azimuth 935.73 feet; thence southerly 180° 22’ 12” azimuth 851.32 feet along the east line of said Northeast Quarter of the Southeast Quarter to the point of beginning. Said property is 828,251 square feet or 19.0140 acres more or less. Section 2 This growth policy amendment shall be in full force and effect upon passage.
