A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING
A SPECIAL ASSESSMENT OF TAXES UPON CERTAPT PROPERTIES IN 'fHE CITY OF
BOZEI'!IAN, COTTN'rY OF (}ALLATIIN, STATE OF rn:OH'rAHA, TO DEF'RAY THE COST OF
CONSTRUCTING AND INSTALLING Alm/OR REPAIRING MISCELLANEOUS SIDEWALKS
AND CIJRBS DURING THE YEAR 1958.
WHEREAS, the Commission of the City of Bo~eman, pursuant to the provisions
I of Ordianance No. 561, entitled:
"AN ORDINANCE GOIJEHNVJG THE CONSTRUCTION AND INSTALLATION OF CON"CRETE
CUPBS AND SIDEWALKS IN 'rHE CITY OJi' BOZEMAN, PROVIDING PENALTIES FOR
THE: VIOLATION OF TIHS ORDINANCE AND REPEALING ORDINANCES NOS. 36.5,
374, 425, 447, 449, AND 451, AND ALL OTHER ORDINANCES AND PARTS OF
ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HEREWITH",
and the provisions of section 11-2226, Political Code, R.C.M., 1947, provided for
the construction of sidewlks and curbs in the City of Bozeman d1Eing the year 1958,
without the formation of a Special I~provement District;
WHEREAS, proceedings were had for the construction and in installation and/
or repair of Miscellaneous Sidewlks and Curbs in the City of Bozeman for the year
1958, and
WHEREAS, miscellaneol1.s Sidewlks and Curbs were constructed and installed
and/or repaired bordering on various properties in the City of Bozeman, pursuant
to OrdinAnce No. 561, Section 11-2226, Political Code, R.C.M., 1947, which are
hereby referred to and made a par of this Resolution,
and
WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed
and completed end/tOr repaired in accordance with the terms and conditions of said
proceedinss, and the City Engineer has duly certified to the COt~nission a Schedule
showing the sidewlks and curbs which have been constructed and installed and/or
repaired, and the properties which are subject to assessment thereunder and the
total cost of said constr'uction and installation and/or repairing is the sum of
Nineteen Hundred Si.xty-six and 90/100 Dollars, ($1,906.96), ------ - -- -
which Schedule, marked Schedule "A", is hereto attached and made a part hereof.
NOW, THEREFORE, pursuant to the provisions of Ordinance No. 561 as afore-
said, and Section 11-222b, Political Code, R.C.M., 1947, as afpresaod,
I BE IT RESOLVED AND IT IS HEREB'T ORDERED B'I THE COMMISSION OF Tf!E CITY OF
BOZEI'lfAN, MONTANA:
SECTION 1. That to defray the cost of constructing and installing and/
or repairing M.t scellaneous Sidewalks and Curbs as set forth in Schedule "A",
hereto attached and made a port hereof, there is hereby levied and assessed a tax
amounting to the sum of Nineteen Hundred Sixty-six and 96/100 Dollars, ($1,906.96).
SEc'rION 2. That a particular description of each lot and parcel of land
with the name of the owner and the sum assessed against him or it for such con-
struction and installation and/or repair and the amount of each payment to be
made and the day when the same shall become delinquent is set forth in the assess-
ment list hereto attached marked Schedule "An and made a part hereof; that the
several sums set opposite the name of the owner and the description of the lots
and parcels of land be, and the same are hereby respectively levied and assessed
upon said lots and parcels of land to defray the cost and expense of constructing
and installing and/or repairine; said Sidewalks and Curbs; that the several sums so
assessed be collected from the respective owners of said lots and ~rcels of land
described in said assess~ent list as required by law; that the payment of said
S11ms shall be made in six installments; that the payment of said installments
shall be made on or before the 30th day of November of each year until payment of
all installments together with the interest thereon, shall be made;
that said sums
shall be paid and the collection thereof shall be made in the manner and in accord-
ance with the law governinB the collection of Special Improvement taxes; that
failure to pay such assessments when the same shall become due and payable shall
make such persons and lots and parcels of land liable to the penalties provided
by law relative to delinquent taxes.

SECTION 3. That the regular session of the Commission of the City of
Bozeman to be held in the Commission Chamber in the City Hall of said City on the
I 15th day of October, 1958, at 1:00 o'clock P.M., be, and the same is here design-
ated as the time and place at which obJections to the final adoption of this
Resolution will be heard by said Commission.
SEc'rION h. That the Clerk of the Commission of ~e City of Bo~eman be,
and he is hereby ordered and directed to publish in the Bozeman Deily Chronicle,
a daily newspaper printed and published in the said City of Bozeman, a notice
signed by the Clerk of the Commission and stating that a Resolution levying and
assessing a special assessment of taxes to defray the cost and expense of con-
structing and installing and/or repairing S1idewalks and Curbs in the City of
Bozeman for the year 1958, is on file in the office of the Clerk of the Commission
subject to inspection for a period of five ( 5)
days; that said Notice shall state
the time and place at which objections will be heard by the Commission to the
final adoption of this Resolution; that it shall be published at least five (5)
days before the date set by the Commission for the hearing of objections and the
final adoption of this Resolution.

HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 930, LEVYING ASSESSMENT TAXES, CONSTRUCTION
AND INSTALLATION AND/OR REPAIR MISCELLANEOUS SIDEWALKS AND CURBS IN THE CITY OF BOZEMAN
DURING THE YEAR 1958.
NOTICE IS HEREBY GIVEN, that a regular session of the Commission of the City of Bozeman held on
Wednesday, the 8th day of October, 1958, Commission Resolution No. 930 was provisionally passes
and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon
certain lots and parcels of land in front, or on the side of which, sidewalks and curbs have been con-
structed and/or repaired pursuant to the provisions of Ordinance No. 661 and Section 11-2226, Poli-
tical Code, R.C.M., 1947, to defray the cost and expense of constructing and installing and/or repair-
ing said Sidewalks and Curbs.
That said Commission Resolution is now on file in the office of the Clerk of the Commission,
subject to inspection for a period of five (6) days by any persons interested. That Wednesday the I
15jh day of October, 1958, at 1100 P.M. of said day, at the regular session of the said Commission
of the City of Bozeman at the Commission Chamber, City Hall Building of said Ci~, has been designated
as the time and place when and where the a-aid CommisEion will hear and pass upon any and all objections
that may be made to the final passage and adoption of said Resolution No. 930 and the levying of said
assessment, ~hC that said Resolution will be finel1y passed and adopted at said regular session.
All persons, interested are referred to said Ordinance No. 661, and the Commissioner's proceed-
ings for the construction an~or repair of Miscellaneous Sidewalks and Curbs, in front of or on the
side of lots and parcels of land wi thin the City of Bozeman for the year of 1958 without the formation
of a Special Improvement District.
