AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE }/RO.PERTY IN

WHEREAS, The City Commission of The City of Bozeman, did on the 1st day of May,
I 1957, duly and regularly pass Commis sion Resolution No. 834, entitled:

are hereby roferred
to and made a part of this resolution for further particulnrs in respect to the bound-
aries o~ said district, the character of the improvements
to be constructed therein,
the estim,CJted cost of s aid ImproveMents and the method of assessing the cost against
the property within said district; and
vVIffiREi\S, said improvements as contempla ted in said Conmis sion nesolu tions Nos. 834
and tAl have been constr11cted and COmlJleted in accordance with the terms
and concH tions
of Commis s ion :10 soln tion Nos. d34 and ['.41, and the

Section l. rrhat to defray the cost and oxpense of constructing and making the
im-
provements in said Special Improvement District No. 3e9, there be,
and there is hereby
levied and assosscd a tax am01.mtin{" to the sum of Forty Thousand Six Hlmdred Ten
Dollars and 9/100 (;~4U, 61U. 09 ) upon all tho property in
said Special Improvement Dist-
rIct No. 3H9, that a particular dcscription of each lot and parcel of land with the
name of the owner and the sum assessed ap:ainst him or it for such improvements and the
amount of ench partial paYl1ent to be made and the day when the same shall be delinquent
:'i.s set forth :in detail in the ~ssessment list hereto attached, markod',chedule "A", and
made a pert hereof; th~t the several sums set opposite the
names of the ovmers and the
described lots and parcels of land be, and the same are hereby respectively levied and
assessed u~on and a~alnst saId described lots and parcels of land to defray the cost
and expense of constructinr,: and making the improvements within said District;

several sums so assessed be collected from the respective owners of said lots and p~~e~

accordance with the law governing the collection of special improvement taxes;

faihu'e to pay such assessments when the same become due and payable shall make such
persons 3nd said lots and parcels of land liable to the penalties provided by law rela-
ti ve to delinquent taxes.

Section 3. 'J'ha t the Clerk of the Commission of The City of Bozeman be, a nd he is
hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper
printed and published in the said City of Bozeman, a notice signed by the Clerk of the
Commission and stat:lnc that a nesolution levying and assessing a special assessmont of
taxes to defray the cos t and expense of construe ting and making the improvements in the
said Spocial Improvement District No. 389, is on file in the office of the Clerk of
the
COlYLmission subject to inspection for a period of five ( 5)
da ys ; that said Notice shall

NOTICE IS HEREBY GIVEN, that at a regDlar session of the C011'lY::ission of The City of
Bozeman held on the 24th day of September, 1958,
Commission Resolution No. 924 was pro-
visionally passed and adopted; that said COITmlission Resolution levies and assesses a
special assessment of taxes upon all the property in Special Improvement District 1\b.389
in said City, to defra y the cos t and expense of cons truGting and making the i:nprovements
within said District, to-wit:
Beginning at the Northeast corner of Block sixteen (16) ,
of the Butte Addltlon
to the City of Bozeman, Montana, thence westerly along the South line of West
Garfield Street a distance of 135 feet; thence northerly 135 feet West of and
parallel to the West line of SmIth Grand Avenue to a point on the center line
of West Lincoln Street; thence Easterly along the centerline of West Lincoln
Street to a point 87.85 feet west of the west line of SmIth Grand Avenue;
thence in a s01Jtherly and westerly direction b'l.85 feet west of and parallel to

East line of Sou th Third Avenue;
