The property is listed on the National Register of Historic Places as part of the South Tracy/ South Black Historic District. Dear Mr. Talbot, On May 15, 2014, the Department of Community Development received additional materials to the above-referenced Certificate of Appropriateness (COA) application, which proposes demolition of the structure at 430 South Tracy Avenue. The COA application was preliminarily reviewed by Department of Community Development Staff in accordance with the submittal checklist and Section 38.41 of the Unified Development Code (UDC) and appears to be acceptable for initial review. Given the property’s historic status in the South Tracy/ South Black Historic District, the Director of Community Development will review the application under Sec. 38.16.080.A.3 of the Bozeman Municipal Code (BMC). Your application materials provide information about ways in which the demolition of the structure could satisfy the criteria found in Sec. 38.16.080A.3.b (BMC): The structure or site is a threat to public health or safety, and that no reasonable repairs or alterations will remove such threat; any costs associated with the removal of health or safety threats must exceed the value of the structure. The structure or site has no viable economic or useful life remaining. In order to fully evaluate these issues, the Department of Community Development would like to request access to the site for Community Development Director Wendy Thomas and Chief Building Official Bob Risk. Please contact me in order to coordinate a site examination. The structural engineering report provided in the application materials is seven years old. The Department believes an updated evaluation of the residence’s structural stability would provide information valuable in review of the project. Please provide an updated structural engineering report. Please provide this information by June 24, 2014 in order for the application to be considered adequate for further review under Sec. 38.19.090.A.2 (BMC). Should the requested materials and components not be provided, the project will be deemed inadequate for review and the application materials and one-half of the review fee shall be returned to the applicants. Further, please be aware that the Department of Community Development will seek a third party verification of the costs to rehabilitate the existing structure. The Director of Community Development has this authority under Sec. 38.34.020.B (BMC): The planning director may in the administration of this chapter consult with other persons having expertise in relevant subject areas as in the planning director's opinion is necessary for the review of the proposed development or administration of the chapter. When an authority other than the planning director is assigned responsibility for a particular standard that authority shall coordinate with the planning director in administration of that standard. You will be provided with a copy of the third party estimate. Public notice of an application to demolish a property listed on the National Register of Historic Places is required by the Table found in Sec. 38.40.030, footnote four. A public notice must be posted on site for a minimum of 15 days, and will also be posted on the City’s website and provided to the Intra Neighborhood Council. Public notice of this application will not occur until the application has been deemed adequate for review. The Bozeman Historic Preservation Advisory Board (BHPAB) will discuss the project during their June 2014 meeting. The meeting is tentatively scheduled for 6:30pm on June 24, 2014 in the Upstairs Conference Room of the Stiff Professional Building, at 20 East Olive Street in Bozeman. The Board may choose to reschedule their June meeting in order to provide timely review of this application. Should the Board meeting date change, I will provide you at least 10 days notice. You are invited to attend the meeting. Staff will provide members of the BHPAB a digital copy of the application materials prior to the meeting. It would be really helpful if the items noted above, especially the updated structural report, could be included in the packet of information to the Preservation Board. Providing the Board members the full extent of information about the residence’s existing conditions would create a more well-rounded dialogue.
