ASSESSING A SFECIAL ASSESSMENT OF '1'AXES UPON CERTAIN PROPERTIES IN
THE CITY OF' BOZEIvTAN, COUNT'{ OP GALLATIN,

FRAY 'rHE COST OF EXTERMINATION AND R8MOVAL OF NOXIOUS WEEDS FOR THE
YEAR 1958 PURSUANT TO THE r'ROVISIONS OF ORDINANCE NO. 428 ENTITLED:

WIrEREAS, the City Council of the City of Bozeman heretofore duly and regularly
passed Ordinance No. 428, entitled:
"AN OFllHNANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABAfl'E-
MENT OF C~RTAIN NUISANCES", and
W:Ff.2;REAS, Section 11-985 R.C.M., 1947,
provides the City or Town Council has power
to declare and determine what vegetation within the City or Town shall be noxious weeds,
and to provide the manner in which they shall be exterminated, and to require the
owner or ovmers of any property within said City or Town, to exterminate or remove
noxious weeds from their premises, and one-half of any road or street lying next to the
lands or boulevard abutting thereon, and to provide,
in the event the o.mers or owner
of any of sald premises neglect to exterminate or remove noxious weeds therefrom,
for
levying the cost of such extermination or removal as special assessment against the
property; and
WHEREAS, owners of premises in said City have neglected to exterminate and
re-
move noxious weeds therefrom during the year 1958 and
the C1 ty of' Bozeman, pursuant to
I Section 11-985 R.C.M., 194'1, and Ordinance No. 428,
have exterminated and removed
noxious weeds from the premises of sald owners and the total cost of the extermina tiOD
and removal thereof is chargeable to t he property as he re inafter set for th,
pursuant to
the provisions of s aid Section 11-985, Political Code,
R.C.M., 1947 , and said Ordinance
No. 428;
BE IT RESOLVED AND IT HEREBY ORDERED BY THE COMMISSION OF THE CITY
OF BOZEMAN, S'I'A TE OF M<YNTANA:
Section 1. Tha t during the year 1958,
the City of Bozeman has exterminated and
removed noxious weeds from properties in the City of Bozeman and defrayed the cost
I thereof as set forth in Schedule hereto attached and made a part hereof.
Sec tion 2. That to defray the cost ($109.02) of
exterminating and removing said
noxious weeds from said premises as set forth in said schedule, hereto attached and
made a part hereof, f'or the year 1958,
there be, and there is hereby
levied and assessed
a special tax a~ainst said property as set forth in said sChedule, hereto attached and
made a p8.r-c hereof; that a part:i.cular description of each lot and parcel of land wi th the
name of the owner and the sum assessed against him or it is set forth in assessment list
hereto attached marked "Schedule One", and made a part he reof;
that the several sums set
opposite the names of the owners and the description of
the lots and parcels of land be,
and the same are hereby levied and assessed upon and against said lots and parcels of
18, nd ; tha t the several sums be collected from the respecti ve owners of'said lots and par-
cels of land described in said assessment list, "Schedu le One", a s required by la w; that
said SlJ.ms shall be paid and the collec tion thereof sha.ll be made in the manner in accord-
ance with the law governing the collection of special improvement taxes; tha t failure
to
pay such assessments when same shall become due and payable shall make such persons and
such lots and parcels of land liable to the penal
ties provided by law r e la ti ve to delin-
quent taxes.
Section 3. That the regular session of the Commission of the City of Bozeman to be
held on the 1st day of October, 1958 at the Commission Room, City Hall
Building, be and
the same is hereby designated as the time and place
at which objections in the final
adoption of this Resolution will be heard by the Commission.
Section 4. That the Clerk of the Commission be,
and he is hereby ordered and
direc ted to publish in thE, Bozeman Daily Chronicle, a daily newspaper printed and pub-
lished in the said- City of Bozeman, a notice signed by the Clerk of the Commission,
stating that a resolution levying a special a ssessment of taxes to defray the cost of
exterminating and removing noxious weeds from certain properties in the City of Bozeman
for the year 1958, is on file in the office of the Clerk of the Commission,
sub j ec t to
inspection for a period of five days; tha t said notice shall state the time and place at
I which objections will be heard by the Commission to the final adoption of this Resolution
that it shall be published at least five days before the date set by the Commission for
hearing of objections, and the final adoption of this I' eso lu t ion.
Provisiona.lly passed by the Commission of the City of Bozeman 3t a regular session
thereof held on the 24th da;sr of September, 1958.

Bozeman held on the 24th day of September, 1958 Comnission Eesolution No. 921 was duly
passed and adopted; tha t said Coulffiission Eesolut ion No. 921 le v:i.es and assesses a s pe cial
assessment of taxes upon certain properties in the City of' Bozeman for
the year 1958 to
def'ra y the cos t of extermina ting and removing noxious weeds for t he ye8r 1958.
Tha t , said Commission Resolution No. 291 is now on file
in the office of the Clerk
of the COrnTIliss1on of said City of Bozeman subject to inspection of all persons interested
for a period of five days; that Wednesday the 1st day of October,
19 5B , at 1:00 o'clock
P.M., of said day a t a regular sessIon of the Commiss ion of the C1 ty of Bozeman, City Hall
Building, has been desjgnated as the time and place when and where the
said Commis s ion
will hear and pass upon any and all objections that may be made to the final passage ard
adoption of said Resolution will be finally passed and adopted at said T'egular session of
said Commission subject to such corrections and amendments as may be made upon objections
made and filed wi thin the five days lim1 t as provided by law.
