I WHEREAS, The City Commission of The City of Bozeman, did on the 3rd day of July 1957, duly and regularly pass Commis s ion Resolution No. 848, entitled: A RESOTJUTION OF THE CITY COMMISSION OF THE CITY OF BOZEYJAN DECLARING IT TO BE THE INTENTION T0 CREATE A SPECIAL D;"PROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS'J'RICT NO. 395 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A IJA VEl\mNT PROJECT ON W EST GRANT STREET FROM SOUTH WILLSON AVENUE TO SOUTH SIXTH AVENUE, SAID PAVEMENT PRO,JECT TO INCLUDE COMBINATION CCNCRETE CURBS AND GUTTERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, AND BITUMINOUS SURFACE COURSE, AND OTHER WORK INCIDENTAL THERETO and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 'lth day of August, 1957, duly pass Commission Resolution No. 856, en~ ti tIed: A RESOLUTION 01" THE CITY COMMISSION OF TIm CITY OF BOZEMAN CREATING A SPECIAL DIPROVEMEWr DIS'T?ICT TO BE KNOWN AS SPECIAL I}\r'PROVEM";'NT DISTRICr.I.' NUMBER 395 01" THE CITY OF BOZEMAN FOR T HE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST GRANT STREET FROM SOUTH WILLSON AVENUE TO SOUTH SIXTH AVENUE IN SAID CITY which Commission Resolution Nos. 848 and 856, passed as aforesaid, are hereby referred to and made a part of this r es olu tion for further particulars in res pec t to the bound- aries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 848 and 856 have been constructed and completed in accordance with the terms and conditions of Commission Resolutions Nos. 848 and 856, and the total cost of said improvements so I constructed is the sum of Thirty Two Thousand Six Hundred Eighty Two Dollars and Sixty Three Cents ($ 32,682.63) NOW, THEREFORE, pu.rsuant to the provis ions of Sec tions 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto. BE IT RESOLVED AND IT IS HE-EBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. Tha t to defray the cost and expense of cons true ting and making the im~ provements in said Special Improvement District No. 395, there be, and there is hereby levied and assessed a tax amounting to the sum of Thirty Two Thousand Six Hundred Eighty Two Dollars and 63/100 ($ 32,682.63) upon all the property in said Special Improvement District No. 395, tha t a particular description of each lot and parcel of land wi th the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked "Schedule "All, and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that theseveral sums so assessed be collected from the respectl ve owners of s aid lots and parcels of land describ8d in said assessment list, SChedule "A", a s required by law; tha t the pa y- ment of said sums shall be made in 19 installments and the payment of said installments, shall extend over a period of 18 years; that the payment of the respective annual in- stallments shall be made on or before the 3Uth day of November of each year until pay- ment of all installments together with the interest thereon, shall be made; tha t said sums shall be paid and tl~ collect~on thereof shall be made in the manner and in accord- ance with the law governing the collection of special improvement taxes; tha t fa ilure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by lawrelative to delin- Quent taxes. I Section 2. That the regu18r session of the Commission of The City of Bozeman to be held in the Commission Chamber j.n the City Hall of said City on the 24th day of' Septenber 1958, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Comm- ission. Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news- paper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessing a special assess- ment of taxes to defray the cost and expense of cor.structing and making the improvemenrn in the said Special Improvement District No. 395 is on file in the office of the Clerk Resolution No. 918 ---..-.- .-. --.. .. ...-. ___._._.__..n 'JQ{j ~""", . ) of the ConL~ission subject to inspection for a period of five (5) days; that said Notice sha 11 sta te the time and place a t which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of objections and till f ina 1 adoption of this Resolution. Provisionally passed and adopted by the Commission of The City of Bozeman at a regulnr session thereof held on the 17th day of September, 1958. II. NOTICE IS HEREBY GIVEN, tha t [1 t a reglll(;r session of the Commission of The City of Bozeman held on the 17th day of September, 1958, Commission Resolution No. 918 was provisionally passed and adopted; that said COIn.111ission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement Dis trict No. 395 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit: Beginning at a point on the west line of South Willson Avenue, said I point being 150 feet north of the north line of West Grant Street, tl~nce westerly 150 feet north of and parallel to the north line of West Grant Street to the east line of South Sixth Avenue; the nee southerly along the east line of South Sixth Avenue to a point 150 feet south of the south line of West Grant Street; thence easterly 150 feet south of and parallel to the south line of West Grant Street to the wes t line of South Willson,r;venue; th0r:c0 noy.thurly along the ~e5t line of South Willson Avenue to the point of beginning. The t, said Commission Resolution No. 918 is now on file in the office of the Clerk of the Commission, subject to inspection for a pertod of five ( 5) days by any persons interested. That Wednesday, the 24th day of September, 1958, at 1:00 o'clock l'.M., of said day at the re~11ar session of the said Commission of The City of Bozeman, at the Commission Room, in the City Hall Bu5.1ding of said City, has been designated as the t:hne and place where the said Commission will hear and pass lJpOn any and all objections that may be made to the final paSS8D:e and adoption of said Per-olution No. 918, and the levy- ing of said 'assessment, and that said Resolution will be finally passed and adopted at said reVJlar session. All persons interes ted are referred to Commiss ion Resolu tion No. 848, declaring it to be the intention of the Commission to create ;;)pecial Improvement District No. 395, and Commis s ion Resohl tion No. 856, creating Special Improvement District No. 395, for con- structing and making the improvements therein.
