I WHEREAS, The City Commission of The City of Bozeman, did on the 22nd day of May, 1957, duly and regularly pas s Commis s ion Resolution No. 837, entitled: A RESOLnTION OF THE CITY COj~ISSION OF 1~ CITY OF BOZEMAN DECLARING IT TO BE TEE INTENTION TO CREATE A SPF,CIAL IMPROVEMENT DISTRICT TO BE KbTOWN AS SPECIAL IMPROVEMENT DISTRICT KO. 391 OF THE CITY OF BOZEMAN FOR THE PURl'OSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT .ON WES'I; HAYES STRI~~T FROM SOU'I'H WI.LSON AVENUE TO SOUTH SIXTH AVENUE, 2AID f'AVEMEN'l' PRO- JECT TO INCLUDE COMBINATION CONCRETE CUHBS AND GUTTERS, GRAVEL BASE COURSE CRUSB'ED G'PAVEL CUSHION COURSE, AND BITUMINOUS SURPACE COURSE AND OTHER WORK INCIDENTAL THl~RETO. and thereafter, after due and legal proceedings had, the Commission of The City of Bozeman did on the 26 th da y of June, 1958, duly pass Commission Resolution No. 844, en- titled: A RESOUTTION OF THE CITY COMMISSION OF' THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVE~ENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 391 OF rfHE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND IN- STALLING A PAVEMENT PROJECT ON WEST HAYES STREET FROM SOUTH WILLSON AVE- NUE, IN SAID CITY wI-dch Commis sion Resolu tion Nos. 837 and 844, passed 8S aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect to the bound- aries of said district, the character of the improvements to be constructed therein, the estiITated cost of said improvements and the method of assessing the cost against the property within said district; and WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 837 and 844 have been constructed and completed in accordance with the terms and conditions or Commission Resolutions Nos. 837 and 844, and the total cost of said improvements so I constructed is the sum of Thirty Thousand Eight Hundred Ninty Five Dollars and Twenty Seven Cents ($ 30,895.27) NOW, THEREF'ORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto. BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the im- provements in said Special Improvement District No. 391, there be, and there is hereby levied and assessed a tax amounting to the sum of Thirty Thousand Eight Hundred Ninty Five Dollars and 27/100 ($ 30,895.27) upon all the property in said Special Improvement Dis tric t no. 391, tha t a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvem~nts and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names of the owners and the described lots and parcels of land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructing and making the improvements within said District; that the several sums so assessed be collected from the respective owners of said lots and par- cels of land described in said assessment list, Schedule "A", as required by law; that the payment of said sums shall be made in 20 installments and the payment of said in- stallments shall extend over a period of 19 years; that the payment of the respective annual installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be madej that said sums shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law rela- I tive to delinquent taxes. Tha t the regulnr session of the Commiss ion of 'l'he City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 24th day of September, 1958, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place a t which objections to the final a doption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news- paper printed ana published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating that a TIesolution levying and assessing a special assess- ment of taxes to defra y the cos t and expense of cons true ting and making the improvemenm in the said Special Improvement District No. 391 is on file in the office of the Clerk Resolution No. 917 29:1 of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it sh811 be published at least five ( 5) days before the day set by the Commission for the hearing of objections and the final adoption of this Resolution. NOTIC IS HEEEBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 17th day of' September, 1958 , Commission Resolution No. 917 was provisionally passed and adopted; tha t said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District 391 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-vvi t ; I Beginning at a point on the e8st line of' Block 15, Butte Addition to the City of Bozeman, said point being 150 feet north of the North line of West Hayes St., thence westerly 150 feet north of and parallel to the North line of West Hayes Street to the East line of SOt'tth Sixth Avenue; thence southerly along the east line of South Sixth Avenue to a point 150 feet south of the sou.th line of West Hayes Street; thence easterly 150 feet south of and paralle 1 to the south line of West Hayes Street to the West line of South Willson Avenue; thence northerly along the west line of South Willson Avenue to the point of beginning. Tha t, said Commission ResoJ.ution ~!o. 917 1s now on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days by any persons in te res ted. Too t Wednesday, the 24th day of September, 1958, st 1:0U o'clock P.M., of said day at the regular session of the said Commission of The City of Bozeman, a t the Commission Room, in the City Hall Building of said City, has been designated as the time and place where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 917, and the levy- ing of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 848, declaring it to be the intention of the Commission to create Special Improvement District No. 391, and Commission Resolution No. 856, creating Special Improvement District No. 391, for constructing and making the improvements therein.
