LEVYI NG
AND ASSESSING A SPECIAL ASSESSMENT OF TAX~~S UPON ALL THE PROPERTY IN
SPECIAL IMPROVEMENT DISTRICT NO. 386 IN THE CITY OF BOZEkAN,
COUNTY OF
GALLATIN, STATE OF MONTANA,
TO DEFRAY THE ~OST OF CONSTRUCTING AND MAK-
ING THE nq)ROVE~mNTS VVITHIN SAID SPECIAL IMPROVEMENT DISTRICT NO. 386.
WHEREAS, The City Commission of The City of Bozeman,
did on the 27th day of June,
I 1956, duly and regularly pass Commission Resolution No. 812, entitled:

TO BE TIm INTENTION TO CREATE A SPECIAL IMPROVEMENT DISTRICT NO.
386 OF'
THE CITY OF BOZEMAN FOR THE r'URP03E OF CONS'l'RUCTING AND INSTALLING A
PAVEMENT PROJECT ON SOUTH WILLISON AVENUE FROM GARFIELD STREET TO GRANT
STREET, SAID PAVEMENT PROJECT TO INCL1JDE THE CONSTRUCTION AN'0 INSTALLA-
TION OF j\ STORM SEWER LINE, CONCRETE CURBS A~ID GUTTERS,
GRAVEL BASE
COURSE, CRUSHED GTIA YEL CUSHION COURSE, AND BITUMINOUS SURFACE
COURSE.
and thereafter, after due and legal proceedings had,
the Commission of The City of
Bozeman did on the 3rd day of October, 1956, duly pass Commission Resolution No. 823,

titled:
A RESOLUTION OF THE CITY COMlVIISSION OF THE CITY OF BOZEMAN CREATING A
SPECIAL IMPROVEMENT DIS'l'RICT TO BE KNOWN AS SP8CIAL HTPROVEMEN'l' DISTRICT
NUMBER 386 OF THE CITY OF BOZEMAN FOR THE PURPOSE 01i' CONS'I'RUCTING
AND
INSTALLING A PA VEMENT P~OJECT ON SOUTH WILLSON A VENUE FRU1\1 GARFIELD STREET
IN SAID CITY.
which Commission Resolution Nos. 812 and 823, passed as aforesaid, are hereby
referred to
and made q part of this resolution for further particulars in respect to the boundaries
of s aid district, the charac ter of the irrprovements to be cons truc ted therein,
the
estimated cost of said inprovements and the method of assesf:ing the cost against the
property wi thin said dis tric tj and

WHEREAS, said improvements as contemplated in said Commission Resolution Nos. 812
and 823 have been constructed and completed in accordance with the terms
and conditions
of Commission Resolution Nos. 812 and 823, and the total cost of said improvements so
constructed is the sum of Twenty Three Thousand Twenty Four Dollars and B'ifty Six Cents
($ 23,024.56)
I NOW, THEREFURE, pursuant to the provisions of Section
5225 to 5277.5 and 5485,
R. C. M., 1935 and amendments there to,
BE 1'1' RESOLVED AND IT IS HEREBY ORDERED BY THE COlV[]v!ISSION OF THE CITY
OF BOZEMAN, STATE OF MONTANA:
Section 1. That to defray the cost and expense of constructin8 and making the im-
provements in said SpFcial Improvement District No. 386, there be,
and there is hereby
levied and assessed a tax amounting to the sum of Twenty Three Thousand 'l'wenty Pour
Dollars and 56/100 ($ 23,024.56) upon all the property in ssid Special Improvement Dis-
tric t No. 386, that a particular description of each lot and parcel of land with the
name of the owner and the sum assessed against him or it for such improvements and the
amount of each partial payment to be made and the day when the same
shall be delinquent
is set forth in detail in the assessment list hereto attached, marked Schedule "A",
and
made a part hereofj tha t the several sums set opposite the names
of the owners and the
described lots and p8rcels of land be, and the same are hereby respectively levied and
assessed upon and against said described lots and parcels of land to defray the cost and
expense of cons true ting and making the improvements wi thin said Dis tric t;
tha t the
several sums so assessed be collected from the respective owners ofsnid lots and ];Brcels
of land described in said assessment list, Schedule nAt!, as reOl)ired by law;
tha t the
payment of said sums shall be made in twenty installments and the payment of said install-
ments shall extend over a pe riod of nineteen years; that the payment of the respective
annual installments shall be made on or before the 30th day of November of each year until
payment of all installments together wi th the interes t thereon,
shall be made; that said
sums shall be paid and the collection thereof shall be made in the manner and in a~cordance
wi th t he law governing the collectbn of spe cial improvement taxes; tha
t failure to pay such
assessments when the same become due and payable shall make such persons and said lots and
parcels of land liable to the penalties provided by law relative to delinquent taxes.

to be
held in th'e Commission Chamber in the City Hall of said City on the 1st day of October,

which objections to the final adoption of this Resolution will be heard by said COIDr::i.ission.

printed and pl.Jblished in the said City of Bo~eman, a notice

NOTICE IS I-lEI':EBY GIVEN, that at a reRUlar session of the Commission of The City of
Bozeman held on the 24th day of Septeniber~ 195d, Commission Hesolution No. 02(', was pro-
visionally passed and adopted; that said Commission Resolution levies and a:Jsesses a
Special Improvement District No. 386 in said City, to defray the cost anQ expense of con-
structing and making the improvements within s aid District, to-wit:
Beginning at the Northeast corner of Block Fifteen (15), of the Thltte
Addition to the City of Bozeman, thence westerly along the South line of
Vlest Garfield Street to the Northwest Corner of Lot One (1), of said
Block Fifteen (15); Ulcnce Southerly along the E8st line of the alley in
1310c1>::3 Pifteen (15) and Eighteen (18), of said Butte Adcation, to a point
on the North line of West Grant Street; thence Easterly alons the North
line of West Grant ~;treet tothe Southeast corner of Block Nineteen (19),
of said Bt~tte Addition; thence Northerly along the East line of Blocks
Nineteen (19) and Ti'ourteen (14), of said Butte Adclltion, to a point on
the Sou th line of Viest ri8.rfield Street; t hence Westerly along the Sou th
line of Wost Garfield Street to the point of beginning.
'l'hat, s aid Commission r:esolution No. 9~~3 is now on file in the office of the Clerk I
of the Commission, subject to inspection for a period of fi va (5) days by any persons
interested. fJlhat Wednesday, the 1st day of October, 195b, at 1:00 o'clock P.M., of said
day at the regular session of the said Commission of rrhe City of Bozeman, at the Comm-
isslon Roor)") , in the Ci ty Hall Building of said City, has been designa ted as the time and
place when and where the sald Commission will hoar and pass upon any and all objections
tha t may be made to t he final passage and a doption of :::aid TIesolu tion No. 923, and the
levying of said assessment, and that said Resolution will be finally passed and adopted
at said regular session.
All pGl"SOnS interes ted are referred to Commiss ion ~le solu tion No. 812, declaring it
to be the intention of the Commission to create Speclal Improvement District No. 3B6,
and Commission Resolution No. 823, creating Special Improvement District No. 386, for
constructing and making, the improvements therein.
