Kirchhoff’s motion to approve the Kagy Gardens II Zone Map Amendment, #Z-07013 MEETING DATE: Monday, March 26th 2007 RECOMMENDATION: Mayor Krauss, after reviewing the record as stating such, should vote on the motion as transcribed below: Motion: It was moved by Cr. Kirchhoff, seconded by Cr. Becker, to approve a municipal zoning designation of “R-1” (Residential Single Household, Low Density District) for Kagy Gardens II Zone Map Amendment #Z-07013 subject to the contingencies listed in the staff memo. Vote: Those voting Aye being Crs. Kirchhoff and Becker Those voting No being Cr. Rupp and Mayor Pro Tem Jacobson. Those Absent being Mayor Krauss. The vote ties 2-2 BACKGROUND: On March 19, 2007 a motion was made by Commissioner Steve Kirchhoff related to the March 19, 2007 Agenda item H 5 [Kagy Gardens II Zone Map Amendment #Z-07013 (Bristor)] to approve a municipal zoning designation of “R-1” (Residential Single Household, Low Density District) for Kagy Gardens II Zone Map Amendment #Z-07013 subject to the contingencies listed in the staff memo. Mayor Jeff Krauss was absent from the proceedings and therefore did not cast a vote at the March 19, 2007 meeting. The vote resulted in a 2 – 2 tie and therefore Mayor Krauss should cast a vote on the motion transcribed above. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission.
