I WHEREAS, The City Commission of The City of Bozeman, did on the 3rd day of ~Ily, 1957, duly and regularly pass Commission Resolution No. 847, entitled: A RESOLUTION OF' THE CITY COMMISSION OF THE CITY OF BO:::EMAN DE- CLARING 1'1' TO BE THE INTENTION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE1ffiNT DIS'I'RICT NO. 394 OF THE CITY OF' BOZEMAN FOR THE PURPOSE OF' CONSTRUCTING AND IN- STALLING A PAVEMENT PROJECT ON SOUTH FOURTH AVENUE FROM WEST GARFIELD STREET TO vmST GRANT STREET, SAID PAVEMENT PROJECT TO INCLUDE COMBINATION CONCRETE CURBS AND GUTTERS, G RAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMINOUS SURFACE COTlRSE, AND SUCH STORM SEWER APPURTENANCES AS REQUIRED, AND OTHER WORK INCIDENTAL THERETO. and thereafter, aftor due and legal proceedings had, the Commission of The City of Bozeman did on the "1th day of August, 1957, duly pass Commission Resolution No. 855, entitled: A RESOLUTION OF THE CI'l'Y COMMISSION OF' THE CITY OF BOZEMAN Cmi;~TING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SFECIAL IMPROVEMENT DIS'i'RICT NUMBER 394 OF' THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON SOUTH FOURTH AVENUE FROM WEST GARFIELD S'l'REET TO WEST GRANT STREET IN SAID CITY. which Commission ResolutioreNos. 847 and 855, passed as aforesaid, are hereby referred to and made a part of this resolution for further particulars in respect to the bound- aries of said district, the character of the improvements to be constructed therein, the estimated cost of said improvements and the method of assessing the cost against the property within said district; and I WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 847 and 855 have been constructed and completed in accordance with the terms and con- ditions of Commission Resolutions Nos. 847 and 855, and the total cost of said improve- ments so constnJcted is the sum of Eleven Thousand Three Hundred Forty Five uollars and Thirty Cents (:~; 11,345.30) NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485, R.C.M., 1935 and amendments thereto, BE IT RESOLVED AND IT IS HEEEBY ORDERED BY THE COMMISSION OF THE CITY OF BOZE}:!AN, STATE OF MONTANA: Section 1. That to defray the cost and expense of constructing and making the im- provements in said Special Improvement District No. 394, there be, and there is hereby levied and assessed a tax amounting to the sum of Eleven ~housand Three Hundred Forty Five Dollars 30/100 (;8,11,345 .3u) upon all the property in s aid Special Improvement District No. 394, tha t a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day when the same shall be delinquent is set forth in detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that the several sums set opposite the names or the owners and the described lots and parcels or land be, and the same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and expense of constructjng and mak.ing the improvements within said District; tha t the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list, Schedule "A", as required by law; that the payment of said sums shall be made in twenty installments and the payment of said installments shall extend over a period of nineteen years; tha t the pa yment of the respective annual installments shall be made on or before the 30th day of November of each year until pay~ent of all installments together with the interest thereon, sha 11 be made; that said sums shall be paid and the collection thereof shall be made in the I manner and 2.D accordance with the law governing the collection or special improvement taxes; tha t fa i lure to pay such assessments when the same become due and payable shall make such persons and said lots and parcels of land liable to the penal ties provided by law relative to delinauent taxes. That the regular session of the Commission of The City of Bozeman to be held in the Commission Chamber in the City Hall of said City on the 1st day. of October, 1958, at 1:00 o'clock P.M., be, and the same is hereby designated as the time and place at which objections to the f Ina 1 adoption of this Resolution will be heard by said Commission. SE:C tIon 3. f}'hat the Clerk of the Commission of The City of Bo?~eman be, and he is hereby ordered and directed to p1J.blish in tho Bozeman Daily Chronicle, a daily D6WS - paper prInted and published in the said City of Bozeman, a notice signed by tne Clerk of the Con;n:ission and stating that a Resolution levying and assessing a special Bssess- men t of taxes to defra y the cos t and expense of cons truc ting and !11akin@; the improvements ---.- --.- : lft'l in the soid Special Improvement District No. 394 1s on file in the office of the Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall st8.te the time and place at which ob,jections will be heard by the Commission to the final adortion of this Resolution; that it shall be published at least five (5) days before the day set by the Commission for the hearing of ob,jections and the final adopt- ion of this Resolution. Kayor NOT ICE ------ I-illARING, FINAL ADOPTION OP CmnnSSION RESOLUTION NO. 922 LEVYING ASSESSMENT SPECIAL IMPROVEMENT DIS~'RICT NO. 394, CITY OF BOZE1VlAN, PAVING ON POURTH AVENlJE BETWEEN GARFIELD STREET AND GRANT STREET. NOTICE IS HEREBY GIVEN, that at a regular session of the Comll1ission of The City of Bozeman held on the 24th day of September, 1958, Commission Resolution No. 922 was pro- visionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon all the property in Special Improvement District No. 394 in said City, to defray the cost and expense of constructing and making the improvements within said District, to-wit; Beginning at a point on the south line of West Garfield Street, said point being 120 feet west of the west line of South Fourth Avenue, thence southerly 120 feet west of and parallel to the west line of I. South Fourth Avenue to the north line of Wec:t Grant Street; thence easterly along the north line of West Grant Street to tile west line of South Third Avenue; thence northerly along the west line of Soutl1 Third Avenue to the SO"llth line of W."3st Garfield Street; tbence west- erly along the south line of West Garfield Street to the point of be- ginning. That, said C011'll11ission Resolution No. 922 is now on file in the office of the Clerk of the Cormnission, subject to inspection for a period of five (5) days by any persons interested. That Wednesday, the 1st day of October, 1958, at 1:00 o'clock P.M., of said day at the regular session of the said Commission of The City of Bozeman, at the Cormniss- ion Room, in the City Hall Building of said City, has been designated as the time and place when and where the said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Resolution No. 922, and the levying of said assessment, and that said Resolution will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 847, declaring it to be the intention of the Commis sion to crea te Special Improvement District No. 394 and and Commission Resolution No. 855, creating Special Improvement Dis1rict No. 394, for constructing and making the improvements therein.
