COMMISSION RESOLUTION NO. 916 A RESOLUTION OF THE COMMISSION OF' THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND REMOVED DURING THE YEAR 1958, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DISPOSING OF GARBAGE UNDER THE PROVISIONS OF' ORDINANCE I NO. 696 OF THE CITY OF BOZEMAN. WlffiREAS, the City Commission of the City of Bozeman did on the 8th day of January, 1940, duly and regularly pass Ordinance No. 696, entitled: AN ORDINANCE DEFINING G.ARBAGE FOR THE PURPOSE OF TI-US ORDINANCE PROVIDING FOR 'THE COLLECTION AND DISPOSITION THEREOF BY AND UNDER THE SlJP1?RVISION AND CONTROL OF THE DEPARTME}~ OF l~BLIC WELFARE AND FOR DEFRAYING THE COST OF S'TH COLLECTION AND DISt'OSITTON BY SPECIAL ASSESSMENT AGAINST THE PROP~RTY TO WHICH &TCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE, which Ordinance No. 696, passed as aforesaid is hereby referred to and made a part of this Resolution for further particulars in respect to the basis and method of assessing the cost against the property herein assessed, and WHEREAS, said expense incurred by said City in the collection and disposition of garbage in accordance with said Ordinance is hereby estimated by the Commission of the City of Bozeman to be the sum of Forty Three Thousand One Hundred Thirty ~ight Dollars and Seventy Eight Cents ( $ 43138.78) for the year 1958, over and above all mor,eys collected from business and professional concerns, or combined re" sidence and business or residences and professional business concerns in accordance with said Ordinance No. 696, and WHEREAS, in order to raise said sum to defray the said cost, it is necessary to establish the basic unit rate as defined in said Ordinance No. 696 at Thirteen Dollars ($ 13.00) NOW, THEREFORE, pursuant to the provisions of~. aid Ordinance No. 696, and the laws of the State of Montana, I BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSI ON OF' THE CITY OF BOZEMAN, S TATE OF MONTANA: See t:ton 1. That to defray the estimated cost and expense of collecting and disposing of garbage in the City of Bozeman for the year 1953, there is hereby levie'1. and assessed against the property and the several lots, pieces and parcels of land trereof within the City of Bozeman as set forth in Schedule "A", which is attached hereto and made a part hereof, a tax; that a particular description of each lot and parcel of land with the name of the owner and/or owners and the sum assessed agains t the same is set forth in the assessment list in said Schedule "A"; tha t the several sums set opposite the names of said owners and the described lots and parcels of 18nd, be, and the same are hereby levied and assessed upon and against lots and parcels of land for said purpose; that the several sums be collected from the res" pective owners of said lots and parcels of land described in said assessment list and owned by them; tha t the said sums sha.Ll be paid and the collection the reof be made in the manner and in accordance with Ordinance No. 696 of the City of Bozeman, Montana, and the laws of the State of Montana governing the collection of special im" provement taxes; tha t failure to pay such assessment when the same shall beCJme due and payable shall make such persons and such lots and parcels of land liable to the penaJ. ties provided by law rela ti ve to delinquent taxes. That the regular session of the Commission of the City of Bozeman, Mon tana, to be held in the Commission Chamber in the City Hall of said City on the 17th day of September, 1958, at l:UO o'clock ~.M. be, and the same is hereby de- signated as the time and place at which objections to the final adoption of this Re- solution will be heard by said Commission. Section 3. That the Clerk of the Commission of the City of Bozeman, be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in said C1 ty of Bozeman, a notice signed by I the Clerk of tho Commission, stating thRt a resolution levying and assessing a special assessment of tax8s to defray the cost and expense of the collection and dis.. position of garbage in the City of Bozeman for the year 1958, against the property to which such service was rendered, is on file in the office of the Clerk of the Commif!sion, subject to inspection for a period of five days; tha t said Notice shall state the time and place at which objections will be heard by the Commission to the , final 8doption of this Resolution; and that said Notice shall be published at least five days before the date set by the Commission for hearing of objections and the final adoption of this Resolution. . NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the luth day of September, 1958, Commission Resolution No. 916 was provisionally passed and adopted; that said Resolution levies and assesseS e. special a~sessment of taxes to defray the cost of collection and disposition of garbage in the City of Bozman, for the year 1958, upon all property to which such service was rend- e red.
