MEETING DATE: June 16th, 2014 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize City Manager to sign the Professional Services Agreement with Morrison Maierle, Inc. for the 2014 Materials Testing Project. BACKGROUND: Attached is a copy of the partially executed Professional Services Agreement with Morrison Maierle, Inc. for the 2014 Materials Testing Project. The document is in the City’s standard format. On past City projects, the contract documents have required the Contractor to provide all materials testing on the job. This has not proven to be a very effective means of getting these services completed. On one project, the Contractor bid the item very low and in the end chose to forgo payment on the item and not complete the testing. There have also been instances where additional testing in areas was desired, but by having it part of the Contractors responsibilities it would have required a change order to do so. In order to have better control over this portion of the projects, it was decided the City should hire a firm on a 1 year term contract to complete the testing on all City projects. The current list of projects these services are anticipated to be utilized on is the 2014 Water Renovations Project, CTEP Citywide Sidewalks Project, 2014 Story Street Reconstruction Project, 2014 Street Improvements Project, and the 2014 Curb Replacement Project. These services were procured through the City’s consultant selection process. A Request for Proposals was published in the Bozeman Daily Chronicle on March 30th and April 13th, with the proposals being due on April 18th. Proposals were received from 5 firms on the project which were distributed to a selection committee of 5 city employees. Morrison Maierle was chosen as the most qualified based on the written proposals. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission FISCAL EFFECTS: As detailed in Exhibit A to the Professional Services Agreement, the services will be billed on a unit price/hourly basis depending on the testing being performed with 89 a not to exceed limit of $40,000. The costs will be broken down and reimbursed from each individual project and as such spread over the Water, Sewer, and Street enterprise funds.
