HomeMy WebLinkAboutCity Commission Meeting of Bozeman, Montana Agenda Packet 2007-02-12 18-00_36-40_Approve Old Chicago Minor Subdivision Final Plat, #P-06054 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager SUBJECT: Old Chicago Minor Subdivision, Final Plat MEETING DATE: February 12, 2007 BACKGROUND: This is a request for approval of a two lot Minor Subdivision Final Plat to create two new lots within Stoneridge Planned Unit Development. At the December 4, 2006 public hearing, the City Commission voted to approve the Old Chicago Minor Subdivision Preliminary Plat with five (5) subdivision conditions and subject to all applicable subdivision code provisions. The applicant has applied for final plat approval and staff has concluded all terms and conditions of preliminary plat approval have been met. State law provides that the governing body shall approve the plat only if: a) The plat conforms to the conditions of approval set forth on the preliminary plat and to the terms of the state subdivision law and regulations and the regulations adopted by the Bozeman City Commission; and b) The County Treasurer has certified that all real property taxes and special assessments assessed and levied on the land to subdivide have been paid. The County Treasurer has certified that the taxes and special assessments have been paid. Attached is a memorandum from Martin Knight, Associate Planner, delineating how the conditions of preliminary plat approval have been satisfied. RECOMMENDATION: Upon the Director of Public Service’s review and concurrence, the City Commission approves the Final Plat of Old Chicago Minor Subdivision, and authorizes the Director of Public Service to execute the same on behalf of the City of Bozeman. FISCAL EFFECTS: Fiscal impacts are undetermined at this time. On December 4, 2006, the City Commission granted preliminary plat approval for the above referenced project. The Findings of Fact and Order were formally approved by the City Commission on January 8, 2007. Engineering Assistant Andy Kerr has checked for closure. Based on the review of the conditions of preliminary plat approval, Staff finds that all conditions of approval have been met. Please refer to the following conditions and explanation of how they have been met: Conditions of Approval: 1. When two lots are created, each lot will be expected to provide adequate landscaping to comply with the landscape performance standards contained in Section 18.48.060 of the UDO. A revised landscaping plan illustrating how the performance standards will be satisfied must be submitted with the final plat application. Any additional landscaping that is required shall be installed or financially guaranteed prior to final plat approval. The landscaping plan depicts landscaping to fulfill the City of Bozeman requirements. 2. The perpetual reciprocal easement for access, driveways, parking, snow storage, drainage, etc. must be executed prior to final plat approval. This easement has been executed. 3. All existing and proposed easements (including adjacent right-of-way) shall be depicted upon the final plat. All easements are shown. 4. Existing water and sewer service lines shall be accurately depicted upon the final plat. Upon further review, the City of Bozeman Planning and Engineering Departments have determined it to be unnecessary for these services to be shown. 5. The final plat shall comply with the standards identified and referenced in the Unified Development Ordinance. The applicant is advised that unmet code provisions, or code provisions that are not specifically listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the lawful requirements of the Bozeman Municipal Code or state law. The final plat meets the standards set forth. 37 Page 2 Please prepare a City Attorney’s Certificate using the attached Platting Certificate and approve the Certificates as to form. If you find this submittal acceptable, please place it as an item on the next available City Commission Agenda. The application was submitted deemed complete on January 3, 2007; therefore, the 45-working-day review period ends on Monday, March 5, 2007.
