SUBJECT: Bozeman Landfill Convenience Center for Household Hazardous Waste
MEETING DATE: February 12, 2007
CONCLUSION: Planning and Engineering Staff find no restriction on usage of the Household
Hazardous Waste Convenience Station to City residents only.
BACKGROUND: On November 27, 2006, the Bozeman City Commission approved Conditional Use
Permit (CUP) Application No. Z-06245, to allow the City of Bozeman Solid Waste Division to establish a
Household Hazardous Waste (HHW) Convenience Center on City-owned property located at 2143 Story
Mill Road. To date, terms and conditions of the CUP have been met, a Final Site Plan for the project has
been approved, and the Solid Waste Division is prepared to proceed with construction of the facility as
soon as they are authorized to do so by the City Commission.
At the February 5, 2007 City Commission meeting, a representative of a neighbor to the City Landfill
property stated that the approved Conditional Use Permit only allowed use of the HHW Convenience
Station by City residents. She further asserted that allowing use of the HHW Convenience Center by non
City residents would be a violation of the terms and conditions of the CUP.
At the Commission’s request, Planning and Engineering staffs have reviewed the contents of File No. Z-
06245 and find no such restriction on usage in place for the CUP, either as applied for, as advertised, as
reported on, or as approved. In coming to this conclusion, we reviewed the application submittal itself,
the public notice sent to adjoining property owners, the published newspaper notice, the staff report, the
Commission’s public hearing record, and letters of approval. In these documents, we find no reference to
limiting the usage of the HHW Convenience Center to City of Bozeman residents. Many of these
documents were part of the original packet submitted to the Commission for your CUP hearing on
November 27, 2006, and may still be viewed on line under Past Agendas/Digital Packets at
WWW.bozeman.net.
