SUBJECT: The Parking Garage Conditions of Approval, #Z-05006
MEETING DATE: Monday, February 12, 2007
BACKGROUND: At its March 7, 2005 public hearing, the Bozeman City Commission voted to
conditionally approve the Site Plan and COA with deviations for The Parking Garage, subject to six
(6) Conditions of Approval and eleven (11) Design Conditions. At that time, Design Conditions 4,
5, 6 and 10 were omitted. At its May 16, 2005 public hearing, the Bozeman City Commission
reconsidered the conditions of approval and voted to omit Design Conditions 2, 7, 12 and 14.
Therefore, the Site Plan and COA with deviations for The Parking Garage, was granted approval
contingent upon satisfactorily meeting the following six (6) Conditions of Approval:
1. The final site plan shall describe the preservation measures being implemented to protect the
existing trees. These preservation measures shall be reviewed and approved by the City
Forester prior to final site plan approval. If any trees are to be removed their appraised value
must be paid to the Forestry Division.
2. The applicant shall ensure that the street trees include a variety of species, and are not limited to
elms.
3. Installation of a traffic signal at the intersection of Mendenhall Street and Black Avenue is
required as a part of the Phase 1 development of this site. The installation of a traffic signal at
the intersection of Mendenhall Street and Tracy Avenue is to be installed in a future phase of
the City Center Development per the Traffic Impact Study.
4. The requested code relaxation to the parking standards in UDO Section 18.46.020 to allow 18
foot long parking stalls and 24-foot aisle width is acceptable with the following provision.
Signs are to be posted at the parking garage entrances noting the maximum permissible vehicle
length is 18 feet.
5. The requested code relaxation to the drive access standards in UDO Section 18.44.090 D. for
the drive approaches on Mendenhall Street and Black Avenue is acceptable with the following
provisions. A left-turn only lane is to be provided for the Mendenhall Street access (but not
between the drive access and Tracy Avenue) per the Traffic Study Update in a letter from
Marvin & Associates dated January 11, 2005. The drive approach exit on Black Avenue is to be
right-turn only.
6. The applicant is advised that any newly-constructed establishments responsible for food
preparation shall install an outside two-compartment grease interceptor. Interceptor design and
installation is subject to City of Bozeman Building Department approval. In accordance with
Municipal Code, the applicant is further advised that on-site maintenance records and

interceptor service shall be maintained on a regular basis and made available to the City upon
request.
And the following seven (7) Design Conditions:
1. The Final Site Plan shall depict a cornice and parapet (with a minimum height of four feet) for
all ground retail facades.
2. The Final Site Plan shall depict vertical architectural elements and/or divisions that define each
storefront window bay of the ground retail facades.
3. The Final Site Plan shall depict the pedestrian plaza along North Tracy Avenue with a mixture
of ground surface materials (to distinguish pedestrian from street space).
4. The Final Site Plan shall depict the ground retail storefronts as providing at least 1.5 feet of
unglazed base.
5. The Final Site Plan shall depict all windows as having clear, non-reflective glazing.
6. The Final Site Plan shall include a lighting plan that depicts the following: a) accent lighting
proposed on all elevations of the parking garage structure, b) streetscape lighting fixtures
proposed along North Black and Tracy Avenues and East Mendenhall Street, and c) streetscape
lighting fixtures proposed along the alley.
7. The applicant shall provide a color and materials palette for all materials proposed in the new
construction, for review and approval by Administrative Design Review Staff, prior to Final
Site Plan approval.
UNRESOLVED ISSUES: The applicant has determined that they are unable to comply with the
following conditions.
3. Installation of a traffic signal at the intersection of Mendenhall Street and Black Avenue is
required as a part of the Phase 1 development of this site. The installation of a traffic signal at
the intersection of Mendenhall Street and Tracy Avenue is to be installed in a future phase of
the City Center Development per the Traffic Impact Study.
MDOT has found that the warrants do not exist at this time to require the installation of traffic
signal.
Staff recommends that Condition 3 be amended to state:
Installation of traffic signals at the intersections of Mendenhall Street and Black Avenue and
Mendenhall Street and Tracy Avenue shall be installed in a future phase of the Parking
Garage per the Traffic Impact Study if MDOT warrants have been met.
5. The requested code relaxation to the drive access standards in UDO Section 18.44.090 D. for
the drive approaches on Mendenhall Street and Black Avenue is acceptable with the following
provisions. A left-turn only lane is to be provided for the Mendenhall Street access (but not
between the drive access and Tracy Avenue) per the Traffic Study Update in a letter from

Marvin & Associates dated January 11, 2005. The drive approach exit on Black Avenue is to be
right-turn only.
Due to the redesign of the parking garage to became a multi-model facility and accommodate
buses, it was determined that the existing right-of-way of Mendenhall Street was not sufficient to
allow a left-turn only lane. The City of Bozeman Engineer can grant relaxations from the
standards found in Section 18.44.090 D of the BMC.
Staff recommends that Condition 5 be amended to state:
The drive approach exit on Black Avenue is to be right-turn only. The configuration of the
Mendenhall Street drive access shall be as shown in the Marvin & Associates Traffic Impact
Study for Bozeman Downtown Intermodal Facility, dated September 2006.
RECOMMENDATION: The City Commission amends Conditions of Approval 3 and 5 as
recommended by staff since they have been determined to be unreasonable as written.
FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased
property tax revenues from new development, along with increased costs to deliver municipal
services to the property.
ALTERNATIVES: As suggested by the City Commission.

Request to Change Conditions of Approval
As part of this design submittal we are requesting changes to the following
Conditions of Approval:
Condition 3:
Installation of a traffic signal at the intersection of Mendenhall Street and
Black Avenue is required as a part of the Phase1 development of this site.
The installation of a traffic signal at the intersection of Mendenhall Street and
Tracy Avenue is to be installed in a future phase of the City Center
Development per the Traffic Impact Study.
We are requesting that the condition of approval be changed to allow
postponement of the installation the traffic signal at the intersection of
Mendenhall Street and Black Avenue.
Reason/Justification
The traffic signal warrant study of the proposed traffic signal at Mendenhall
Street and Black Avenue notes the intersection meets one warrant (Peak
Hour) and both the north and south approaches (local streets) will have a
projected level of service (LOS) “F” after the parking garage is built. Per the
Unified Development Ordinance, intersection improvements are necessary to
improve the level of service. A Condition of Approval for the parking garage
was approved requiring the installation of a traffic signal at the intersection of
Mendenhall Street and Black Avenue.
Since Mendenhall Street is a state urban route, the Montana Department of
Transportation (MDT) was provided the traffic signal warrant study for their
review and concurrence. In a September 6, 2005 letter, MDT stated the signal
is not warranted and justified. MDT recommended that the traffic signal not be
installed until it is fully warranted and justified.
Without a traffic signal, Mendenhall Street will continue to operate at a LOS
“A” and the north and south approaches of Black Avenue will continue to have
a “stop” sign. The need for a traffic signal can be revisited in the future after
the parking garage is built and in operation.
Condition 5:
The requested code relaxation to the drive access standards in UDO Section
18.44.090 D. for the drive approaches on Mendenhall Street and Black
Avenue is acceptable with the following provisions. A left-turn only lane is to

be provided for the Mendenhall Street access (but not between the drive

We are requesting that the condition of approval be changed to read as
follows: The drive approach exit on Black Avenue is to be right-turn only. The
configuration of the Mendenhall Street drive access shall be as shown in the
Marvin & Associates Traffic Impact Study for Bozeman Downtown Intermodal
Facility, dated September 2006.
Reason/Justification
Since the Conditions of Approval for the parking garage were approved, the
applicant was required to provide transit related facilities at the site. The
selected alternative for the location of the transit related facilities is the garage
frontage along Mendenhall Street between Black and Tracy Avenues (See
attached Figure 3). This requires the designation of a separate bus lane and
the installation of a separate raised island in Mendenhall Street for passenger
loading and unloading because the passenger access is on the right side of
the bus and Mendenhall Street is a westbound one-way street. The length of
the raised island is sufficient to accommodate 4 - 30 ft buses. The length of
the raised island and the bus lane extends most of the distance between the
garage’s Mendenhall Street approach and Black Avenue, leaving no room for
a designated left-turn only lane into the parking garage, as was conditioned.
The left-turn movement into the parking garage can be accomplished from the
left driving lane on Mendenhall Street. The buses departing from the bus lane
will be required to yield to oncoming traffic before entering into the left driving
lane. If there is a queue of vehicles waiting to enter the parking garage, a
departing bus would then wait for a gap in traffic to enter Mendenhall Street.
