SUBJECT: IFCR-0604, Baxter Lane
MEETING DATE: Monday, February 5, 2007
BACKGROUND: The City has adopted an impact fee program to fund necessary infrastructure.
The Capital Improvements Program (CIP)allocates funds to individual projects. The FY 2007 CIP
specified funding for widening of Baxter Lane. This work included some adjustments to the
intersection and signal at Baxter Lane and N. 19th Avenue. This is an intersection of a collector and
arterial street. An approved development in the area requires capacity expansion at this intersection
prior to moving to completion. Per Chapter 3.24, Impact Fees, BMC those elements of work
required for minimum compliance with locally adopted standards are not eligible for funding with
impact fees. This commonly results in a portion of an overall project being funded with impact fees
and a portion with other money.
A request has been received for impact fee credits. A private developer has proposed to complete
the necessary work and wishes to be compensated for the work. This request is consistent with the
adopted impact fee program, Chapter 3.24, BMC. The specific section addressing credit for work
done is Section 3.24.100, BMC. Plans and estimated costs have been submitted and reviewed. The
work appears adequate. The final credit awarded will be based upon actual costs supported by
documented expenditures.
The method to separate project related costs from capacity expanding costs has been established
during the Babcock and Durston rebuild projects. That portion of the work which replaces existing
roadway is considered to be repair/replacement and is not eligible for impact fee funding. Those
portions which widen the street and address intersection/traffic signal can be considered for impact
fee funding. The typical signal funding is 100% eligible and road widening is 70% capacity
expansion. Final numbers will be set when final costs and work are complete.
UNRESOLVED ISSUES: None
RECOMMENDATION: The City Commission approve application #IFCR-0604 with the
conditions listed below.
1. The credit will be paid as a single amount.
2. The final value of the credit will not be determined until final project costs are available. A preliminary
credit of $701,210.38 has been identified based upon awarded bids for total work less anticipated
project related costs. The final credit value will be adjusted to remove project related costs as required
by Chapter 3.24, BMC.
3. No credits will be available until the project is completed and accepted and final costs for the project
are provided to and accepted by the City.

4. The applicant shall agree in writing to the above listed conditions of approval prior to the credits
becoming effective.
FISCAL EFFECTS: The City will expend a defined quantity of funds. The money was collected
for this purpose and the work has been identified as desirable by the City.
ALTERNATIVES: As suggested by the City Commission.
