HomeMy WebLinkAboutResolution 897 Intention to create SID 405 u_ '):--r: ,;~,Ja COMMISSION RESOLUTION NO. 897 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DE- CLARING IT TO BE THE: INTENTION OF THE CI TY OF BOZEMAN TO CREATE A S~ECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 4u5 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A PAVEMENT PROJECT ON WEST ALDERSON STREET FROM SOUTH FOURTEENTH A VENUE TO SOUTH FIFTEENTH AVENUE, I ON WEST DICKERSON STREET FROM SOlJTH FOURTEENTH A VENUE TO SOUTH FIFTEENTH AVENUE, AND ON WEST STORY STREET FROM SOUTH FOURTEENTH AVENUE TO SOUTH FIFTEENTH AVENUE, SAID PROJECT TO INCLUDE THE CON- STRUCTION AND INSTALLATION OF COMBINATION CONCRETE CURBS AND GUT- TERS, GRAVEL BASE COURSE, CRUSHED GRAVEL CUSHION COURSE, BITUMIN- OUS SURFACE COURSE, SUCH STORM SEWER APPURTENANCES AS ARE REQUIRED, AND OTHER WORK INCIDENTAL THERETO WHEREAS: There has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on West Alderson Street from South Fourteenth Avenue to South F1fteenth Avenue, on West Dickerson Street from South Fourteenth Avenue to South Fifteenth Avenue, and on West Story Street from South Fourteenth Avenue to South Fifteenth Avenue in said City asking that a special improvement district be created for the purpose of constructing and installing a pavement project to include the construction and installation of com- bination concrete curbs and gutters, gravel base course, crushed gravel cushion course, bi tum1nous surface course, such storm sewer apJ2urtenance as are required, and 0 ther work incidental thereto; and WHEREAS: That at a regular meeting of the City Commission of the City of Bozeman held on the 23rd day of April, 1958, the aforesaid petition was respectively consid- ered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention I That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 405 of the City of Bozeman for the purpose of constructing and installing a pave- ment project on West Alderson Street from South Fourteenth Avenue to South Fifteenth Avenue, on West Dickerson Street from South Fourteenth Avenue to South Fifteenth Avenue and on West Story Street from South Fourteenth Avenue to South Fifteenth Avenue, said pavement project to include the construction and installation of combination concrete curbs and gutters, gravel base course, crushed gravel cushion course, bituminous surface course, such storm sewer appurtenances as are required, and other work incidental there- to. Section 2 Boundaries The boundaries of said Special Improvement District No. 405 are described as follows: Beginning at a po1nt on the East line of South Fourteenth Avenue, said point being 150 feet North of the North line of West Story Stre et, thence westerly, 150 feet North of and parallel to the North line of West Story Street to a point on the East line of South Fifteenth Avenue; thence Southerly along the East line of South Fifteenth Avenue to a point 150 feet South of the South line of West Aluerson Street; thence Basterly 150 feet South of and parallel to t he South line of West Alderson Street to a point on the West line of South Fourteenth Avenue; thence Northerly along the West line of South Fourteenth Avenue to the point of beginning. Section 3 I Character of Improvements Construction of a pavement project on West Alderson street from South Fourteenth Avenue to South Fifteenth Avenue, on West Dickerson Street from South Fourteenth Ave- nue to South Fifteenth Avenue, and on West Story Street from South Fourteenth Avenue to South Fifteenth Avenue to include the construction and installation of combination concrete curbs and gutters, gravel base course, crushed gravel cushion course, bitum- inous surface course, such storm sewer appurtenances as are required, and other work incidental thereto. Section 4 Estimate of Cost The preliminary estimate of cost 1s $20,634.60, including all street excavation, --" 2:)6 ... --- all ma terials, installation costs, engineering and incidentals. Section 5 Method of Assessment - The preliminary estimate of cost set forth is to be assessed against the property within said District on an area basis as follows: Costs of the project will be assessed on an area basis, with the first 25 feet of I each lot next adjacent to the improvement being recorded at double its actual area in computing the assessable area of each lot. On this basis, the assessable area of the district is 257,924.75 square feet. Section 6 Actual Area of District The total actual area of all property within Special Improvement District No. 405, exclusive of streets, avenues and alleys, is 221,079, which is the area on which all protests will be decided. Section 7 Pa yments That payments for said improvements shall be made in twenty (20) annual install- ments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who de- sires to do so. It is proposed to pa y the en tire cos t and expense of' the cons truc tion and installation of said improvements with cash to be obtained from the eale of bonds of said Special Improvement District No. 405, as authorized by law. Such bonds will be in denominations of $lOO.UO each and fractions or multiples of $lUO.OO where necessary, to be issued and chargeable against a fund to be known and designated as Special Im- provement District No. 4u5 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registra- tion, whenever funds are available for that purpose in said Special Improvement District No. 405. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six (6) per cent per annum, which interest shall be chargeable as a part of the cost of construction and installation of said improvement. 'l'he bonds will be issued and sold in accordance with the provia ions I of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, rela ting to Special improvement districts in cities and towns, and any amendments thereof or thereto. Tha t Wedne sda y, the 21st day of May A.D. 1958, at one o'clock p.m. at the Commiss- ion Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 897 as the time and place for hearing objections to the action proposed to be taken by said resolu tion, and when and where any and all persons whose property is wi thin said pro- posed Special Improvement District No. 4u5 on West Alderson Street from South Fourteen- th Avenue to South Fifteenth Avenue, on West Dickerson Street from South Fourteenth Avenue to ~outh Fifteenth Avenue, and on West Story Street from South Fourteenth Ave- nue to South Fifteenth Avenue in said City may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and fIled with the Clerk of the City Commission not ~ ter than fifteen (15) days after date of first publication of this Notice. An approxima te preliminary estimate of the cost of doing such work a nd making such improvements within said District, including all street excavation, all materials, in- stallation costs, engineering and incidentals, which is to be specially assessed against the property within said District is $20,634,60. The total assessable area of all pro. perty whthln the district, exclusive of streets, avenues and alleys with the 25 feet ad- jacent to the improvements taken at double its actual area is 257,924.75 square feet. Property immediately adjacent to and within 25 feet of the proposed improvement is to be assessed at double the assessment against other property in the District. Payment for the improvements is to be made in twenty (a) annual installments over a period of nine- teen (19) years with interest on the deferred payments not to exceed six (6) per cent per annum, payable annually, but this Shall not be construed to prevent payment in full at any regular payment date by any property owner. For a description of the boundaries of said Special Improvement District No. 405 reference is hereby made to Resolution No. 897 of the Commission of the City of Bozeman declaring the intention to create said District, which is on file in the office of the I undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947. Dated this 3uth day of April A.D. 1958.
