SUBJECT: Chief Joseph Middle School Public Informational Hearing (#Z-06295)
MEETING DATE: January 22, 2007
BACKGROUND: Bozeman School District #7 has submitted plans for construction of the new Chief
Joseph Middle School at 4155 Kimberwicke Street, on the north edge of Baxter Meadows PUD. The
District is exercising their right under state law not to comply with regulatory zoning requirements,
including access standards and review procedures. They are, however, subject to Informational Hearing
requirements before the City Commission, where they have the opportunity to present the plans to the
public, and the Commission provides the opportunity for public comment on the proposal. Per state law,
the City Commission shall have no power to deny the proposed use but shall act only to allow a public
forum for comment on the proposed use.
Although exempt from adherence to zoning requirements, the School District (and other public agencies)
are still subject to all building codes, and must also comply with all infrastructure requirements outside of
zoning. The District’s representative, Prugh and Lenon Architects, have had constructive meetings with
the City’s Development Review Committee to address these issues.
RECOMMENDATION: Conduct the Public Informational Hearing, and provide opportunity for public
review and comment on the proposal.

ALTERNATIVES: As suggested by the City Commission.
