A RESOLUTION OF 'FFIE CITY COMMISSION OF THE CITY OF BOZEMAN, MJ1TTANA,
DECLARING IT TO BE THE I1\fTENTION OF SAID COMMISSION TO ABANDON CITY
OF BOZEMAN SPECIAL IMPRO\TF1vlEN'r DISTRICT NO. 1111 AND TO ABANDON THE
MAINTENANCE OF STREET PARKING THEREUNDER, AND DIR}WTING THE CLERK OF

WHEREAS, a petition was filed with the City of Bozeman on April 9, ~958, by owners
of property in Special Improvement District No. 114, of the City of Bozeman, praying for
the abandonment of said District, and
WHEREAS, it appea.rs for the best interest of the City of Bozeman and the property
owners within said Special Improvement District No. llLf that said District be abandoned.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF TBE CITY OF BOZmAAN:
SECTION 1. DECLARATION OF INTENTION. It is hereby declared to be the intention of
the City Commission of the City of Bozeman, Montana., to abandon Special Improvement Dis-
trict No. 114 of said City and to abandon the maintenance of any street parking improve-
ments therein.
SECTION 2. B,JTJNDARIBS OF' DISTRICT. The boundaries of said Special Improvement Dis-
trict no. 114 are as follows:
All of that portion of said City of Bozeman, included within the following
metes and bounds, to-wit: Beginning at a point in the center line of Coll-
ege Street where the same is intersected by the center line of South Grand
Avenue; thence south along the center line of said South Grand Avenue to
the center line of Arthur StrE~et; thence west alone the center line of said
Arthur Street to t he center line of the alley between said South Grand
Avenue and Third Avenue; thence north along the center line of said alley

to the center line of said College Street; thence east along the center
line of sald Coller:e Street to t he place of beginning.
SECTION 3. BENEFITS DECLARED. It is hereby declared by the Commission of the City
of Bozeman that all of the land within the boundaries of said Special Improvement Dis-
trict No. llLJ- will be specially benefited by such abandonment and that it is to the best
interest of the City of Bozeman and the owners of property within the smd District that
the District be abandoned.
SECTION 4. EFFECTS OF ABANDONMENT. Should said Special Improvement District No.
114
be abandoned in conformance to this Resolution and the Notice to be published pursuant
they'eto, it shall be the duty of the owners of the property abutting on the property in-
volved to maintain the same after such abandonment, and such abandonment shall not relieve
said property owners from the assessment and payment of a sufficient amount to liquidate
all charges existing against said Distrlct prior to the date of abandonment.
SECTION 5. TIIm FOR PROTESTS. That the regular session of the City Commission of
the City of Bozeman to be held at the Commission Chamber, City Hall Building, Boz eman,
Montana, on Wednesday, the 30th day of April, A.D. 1958,
at the hour of 1:00 o'clock p.m.
of s aid day, is the time and place when and where the City Commission will hear and pass I
upon all protests duly and regularly made and filed against the proposed abandonment of
said Special Improvement District No. lllj.

COMMISSION RESOLUTION NO. 894 OF THE CITY OF BOZEMAN DECLARING
THE INTENTION OF THE CITY OF BOZEMAN TO ABANDON SPECIAL IMPROVE-
MENT DISTRICT NUMBER 114.
Notice is hereby given that on the 16th day of April, A.D. 1958, at a regular
session of the Commission of the City of Bozeman, Commission Resolution No. 894 en-
ti tIed:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY
OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 114 AND TO ABANDON THE
MAINTENANCE OF STREET PARKINGS THEREUNDER, AND DIRECTING THE CLERK
OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PUR-
SUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED.

That the boundaries of said Special Improvement District No. 114 are as follows:
I All of that portion of said City of Bozeman, included within the following
metes and bounds, to-wit: Beginning at a point in the center line of
College Street where the same is intersected by the center line of South
Grand Avenue; thence south along the center line of said South Grand Avenue
to the center line of Arthur Street; thence west along the center line of
said Arthur Street to the center line of the alley between said South Grand
Avenue and Third Avenue; thence north along the center line of said alley
to the center line of said College Street; thence east along the center line
of said College Street to the place of beginning.
That Wednesday, the 30th day of April, A.D. 1958, at one o'clock p.m., at the
Commission Room of the City Hall, Bozeman, Montana, is the date, time and place set for
the hearing of protests against the abandonment of said Special Improvement District No.
114 and for the passage of the resolution of abandonment.
The t unless forty (4U) percent of the property owners of said Special Improvement
District No. 114 file written protests with the Clerk of the City Commission before the
above specified date and time, a resolution of abandonment of said Special Improvement
District No. 114 will be by the City Commission passed.
That should said Special Improvement District No. 114 be abandoned in conformance
to this Resolution and the Notice to be published pursuant thereto, it shall be the
duty of the owners of the property abutting on the property involved to maintain the
I same after such abandonment, and such abandonment shall not relieve said property owners
from the assessment and payment of a sufficient amount to liquidate all charges existing
against said District prior to the date of abandonment.
This notice is given pursuant to the provisions of Chapter 38 of the Laws of the
32nd Legisla ti ve Assembly,. Sta te of Montana.
