RESOLUTIDN NO. 3139 AS PASSED AND ADOP'J.'ED BY SAID CI'rY COMMISSION ON 'rHE 2ND
DAY OF APRIL, A.D. 1958
WHER8AS, the City Commission of the City of Bozeman on the 2nd day of April, A.D.
I 1958, passed and adopted Commission Resolution No. 089 declaring it to be the intention
of said Commission to abandon Citv of Bozeman Special Improvement District No. 189 and
to abandon the maintenance of street parkings theretmder, which said resolutio:1 of
record and onfile in the office of the Clerk of said City Co~nission
and open to the
inspec tion 0 f the~)Ublic, 'is hereby referred to for further particulars, and
Wd;~REAS , due proof has been made thnt publication of notice of the adoption of sa~_d
Resolution N.J. 889 was duly dude and given as by Inw provided; and
WHEHEAS, at the tiue and place fixed in said Resolution No. J89 for the making and
filing of protests against the abandonment of said Special Improvement District No. 11)9,
and the abandonment of the maintenance of street pEJrkings thereunde!' to-wit, at the hour
of 1:00 o'clock P.M. on Wednesday, the 23rd day of April, A. D. 1958, be'ng a regular
meetin~ time of said City Commission, at the Commission Chamber in the City Hall build-
ing of the City of Bozeman, no orotests were made or filed against the abandonment of
said Special Improvement District No. 189 or aga~_nst the abandonment of maintenance
of street parkings thereunder.
NOW, THEREFORE, BE IT RESOL'IIED HY 'rHE CO:',1MISSION OF THE Crry OF' BOZEMAN:
Section 1. That said Special Improvement District No. 189 of the City of Bozeman,
State of Montana, and the maintenance of street parkings thereunder, be and the sa:ne
is hereby abandoned.
SECTION 2. It shall oe the duty of the owners of property abutting said District
to maintain the same from and after the dtte of this Resolution End such abandonment
shall not relieve said property owners from the assessment and paymerrt of a suc'ficlent
amount tJ liquidate all charges existinr; against said District prior to the date of
abandonment.
Passed and adopted by the Commission of the City of BozermYl at a regular sassioD.
