VffiEREAS, at a regular session of the Commissiun of the City of BOZe'1&n, State of Montana, held on the. 2/)th day of Februarv 19.58, the said Commission duly passed Commis- I sian Resolution No. 1Ji3~_ declaring it to be the intention of the said Commission to create a special improvement d:1strict to be known and designated as special Improvement District No. 401 of the said City for the pl.U'pose of constructing and installing a pfvernent pro- .i ec t on Wes t ArthlU' stree t from South ~J ills on to South Grand A venue, and to sapc ially assess the entire cost and expense of making said improvement against the property within said District under and by virtue of the provisions of the laws of the State of Montana, in such case made and provided and said Commission Resolution No. UBL. is hereby referred to and made a pert hereof for further DHrtic ul& rs in respect to the boundaries of said Special Improvement District No. LOI, the estimated cost Df said improvement and the method of assessing the same against the property of said District; and WHEREAS, Notice of the passage of said Commission Resolution No. BUL; was duly oub- lished, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulrtion printed and published in the Liity of Bozeman, M:mtana, and by sending a cooy of such notice by U. ('I Mail to each person, firm or corporation having property within ,.) . the proposed District at his or its lest known address, upon the same date thft suc~ notice was first Dublished as aforesaid; and due proof having been made of the publica- tion and service of said notice; and WHEREAS, within the time Drovid""d by law and said nublished and served notice there were not sufficlAnt protests agai~st the proposed work and against the creation of said Droposed Special Improvement District No. 401; and the City Commissi?n was in regular session on the 19th day of March 1958, ot one o'clock P.M. of said day at the Commission Chamber in the City Hall building in the said Citv of 3ozeman, the same be ing the tine and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation or extent of said District or both, or either; and it further appei:ring that all of the proceedings for the creation of said District have been lawrul End regular; NOW, THJ~REFORE , B,~; IT RESOLVBD BY THE COMMISSI01<J )F THE CITY OF BOZEMAN: SECTION 1. That said Special Improvement District No. L.j.Ol ?f the C~.ty ,,)f Bozemm, I State of Montana, be and the same 1s hereby Created for the purpose of making the L11prove- ments AS in said Resolution of Intention No. BB~, and hereinafter described.- SECTION 2. SECTION 3. That the entire cost and expense of making the special i~provements herein referred to in said Special Improvement District No. LiOl s~l[111 be paid by Special Improve:nent District Coupon Bonds, as authorized by the laws of the State of MJntana, which bonds shall be in the denomlnEtion of One Hundred Dollars ($100.00) each, and fractions or multiples thereof where necessary, to be isslled and chargeable against a fund to be known as "Special Improver1ent District No. LIOl", said bonds to be redee'nable at the option of the City of BozetJsn. Mon j~ana, whenev'r funds (Ire available ~or that purpose from said Special Improvement Distric~ No. LIOl I~und; said bonds shall draw in- terest at a rate not to exceed six pel'cent (6~o) per annur:1, which shall be chargeable as a part of the cost of said imprOVeJ,lents and shall run "'rom ~he date Jf the registration of said bonds until said bonds are paid. To pay said bonds, e.nd the interest thereon, representing the cost of said improvement, a special assessment shall be levied against all of the lands within said Special Im~ovement District No. 401 as in said Resolution of Intention No. ddL, defined. SECTION Lj. Said assessment and taxes shall be payable in twenty (20) a!1nual in- stallments extending over a period of nlnetee!1 ( 19) years, with interest on deferred oayments; but t~is provision shall hot be construed to prevent full payment at any ti~e. SECTION S. 'rha t tbe Ci ty Engineer be, and he is hereby directed to prepare plans I and specifications for the doing of said work and the ~aking of said imcroveqents. SECTION 6. That pursuant to the provisio.'lS and authority conferred by Section 11-2232, Revised Codes of Montana, 1947, said bonds may be sold to the highest and best bidder therefor for cash, and the proceeds of such sale used in making payment to the contractor, or contractors, for such w.ark, and such paymtm t may be made either, from ti~e ta time, on estimates made by the e11iineer in charge of such improvement for the City or upon the en- tire completion of thE0-mprovements and the acceptance thereof by the City Commission. SECTION 7. That upon completion of plans end specificat~ons by the Citv Engineer for the doing of' said worle and the making of said improvements, the Clerk of the City Commission of the City of Boze~an be, and is'lereh::r, direc ted to publ:i.sh a notice in- vi ting proposols for the furnishing of ma terlal nnll the doing of the work and the making ---.... 'J1 i1 f....._ of said improver.1ent on said Special Improvement District No. L~Ol, which notice shall refer to the plans and sDecificntions on file, by publishing such notice in two (2) lss,les of the Bo,~eman Daily Chro;11cle, a dally newspaper printed and published in the City of Bozeman, not less than ten (10) daysbefore the time such bids will be opened.
