HomeMy WebLinkAboutJ5 Churn Creek Commission Memorandum TO: Honorable Mayor and City Commission FROM: Andrew Epple, Director of Planning Chris Kukulski, City Manager SUBJECT: Request for Extension – Churn Creek Annexation Preliminary Approval MEETING DATE: November 27, 2006 BACKGROUND: Mr. Barry Brown of Churn Creek Partners, and Mr. Brian Gallick, representing Churn Creek Partners, have requested approval from the City Commission for an extension to their Preliminary Annexation Approval, which was granted on December 19, 2005. Preliminary approval was granted for one year, until December 19, 2007. A term of annexation was that Churn Creek Partners prepare and gain approval for a “Sub Area Plan” prior to Final Approval of their annexation. The Sub Area Plan they presented last February was not approved by the Commission, placing the status of the annexation on hold (please refer to Commission Agenda Meeting Minutes of February 21, 2006, on-line, for a record of the proceedings). Churn Creek Partners are prepared to develop and submit a modified Sub Area Plan for presentation to the Planning Board and City Commission, but that process will not be completed prior to the December 19th deadline for Final Annexation Approval. Since they are still interested in annexing the property and developing in the City, they are requesting that their Preliminary Annexation Approval be extended for six months, to allow them time to prepare, submit, and obtain action on a revised Sub Area Plan. Commission options include: 1) grant the six month extension as requested, to keep the prospects of annexation and development of Churn Creek in the City alive; 2) deny the request for extension of Preliminary Annexation Approval, which will effectively kill the Churn Creek annexation proposal for the foreseeable future; or 3) consider elimination of the term of annexation requiring completion of a Sub Area Plan. UNRESOLVED ISSUES: The status of the Sub Area Plan, and of the Annexation proposal itself, remain unresolved issues at this time. RECOMMENDATION: Consider the three options described above; provide applicant with direction regarding desired contents of sub area plan if option 1 is preferred. FISCAL EFFECTS: Annexation of this land will result in increased property taxes to the City, as well as increased costs for delivery of services. ALTERNATIVES: As suggested by the City Commission.
