HomeMy WebLinkAboutF6 West Lincoln Street ZMA adopt ord. 1680 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager SUBJECT: West Lincoln Road Zone Map Amendment MEETING DATE: November 20, 2006 BACKGROUND: On September 7, 2004, the City Commission held a public hearing on a request for an initial zoning designation of a 1.93± acre parcel located west of Alder Court Lane, south of Lincoln Road, and east of Maple Lane. The Commission preliminarily approved the zoning designation of “R- 1” (Residential Single-Household, Low Density District), directing staff to bring back an Ordinance establishing the initial zoning designations upon annexation of the property. RECOMMENDATION: Adopt Ordinance No. 1680. FISCAL EFFECTS: Fiscal impacts are undetermined at this time. ALTERNATIVES: As suggested by the City Commission Respectfully submitted, _________________________________ ____________________________ Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager Attachments: Ordinance No. 1680 ORDINANCE NO. 1680 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP AND ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R-1" (RESIDENTIAL SINGLE HOUSEHOLD, LOW DENSITY DISTRICT) ON APPROXIMATELY 1.93 ACRES LOCATED IN THE NW ¼ OF THE SW ¼ OF SECTION 13, T2S, R5E, PMM, GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to grant a zoning designation of “R-3”, Residential Medium Density District, was properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on August 3, 2004 to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved with a designation of “R-3”, Residential Medium Density District; and WHEREAS, after proper notice, the City Commission held its public hearing on September 7, 2004, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to not be in compliance with the twelve criteria; and WHEREAS, at its meeting held on September 7, 2004, the City Commission found that the proposed zone map amendment would not be in compliance with the Growth Policy and would not be in the public interest, but that a zoning designation of R-1 (Residential Single Household, Low Density District) would be in compliance with the Growth Policy and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as “R-1” (Residential Single Family, Low Density District): Lots 26 and 27 of Beatty’s Alder Court Subdivision, Tract 1 as described in Document No. 2054756, Tract 2 as described in Document No. 2054753, and Tract E as described in Film 191, Page 2361, Records of Gallatin County, situated in the NW ¼ of the SW ¼ of Section 13, T2S, R5E, PMM, Gallatin County, Montana. Said tract of land being 1.93 acres along with and subject to any existing easements. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
