WHEREAS: 'l'here has been filed wIth the Clerk of the Ci ty Commission of the Ci tv I of Bozeman, Monttana, a petition in due form of certain owners of properties situated on West Arth1IT Street from South Willson Avenue to South Grand Avenue in said City asking that a special improvement district be created for the purpose of constructing and installIng a pavement project to include the construction and installation of com- bination curbs and gutters, gravel base course, crushed gravel cushion course, bitumin- ous surface course, and other work incidental thereto: and WHEREAS: That at a regular meeting of the City Commission of the City of Bozeman held on the 19th day of February, 1958, the aforementioned petition was respectively considered and granted; NOW, THEREFOR}~, BE IT RESOLVED BY 'I'HF. CITY COf.1MISSIJN UF 'rHE CIT'!. OF BOZEMAN: SECTION 1. DECLARATION OF INTENTION. 'l'hat it is hereby declared to be the inten- tion of the Oi ty of Bozeman to crea te a special imlJrovement district to be known and designated as Special I'I1provement District No. 4,01 of the Git:! of Bozeman for the pur- pose of constructing and installing a pavement project on West Arthur Street from South Willson Avenue to SJuth Grand Avenue, said pavement project to include the construction and ins talla tion of combination curbs and glJ.t ters, gravel base course, crushed gravel cl1shion course, bituminous surface course, and other work incidental thereto. SECTION ? BJUNDARIES. The boundaries of said Special Improvement District No. 1101 are described as follows: Beginning at the Northeast corner of Lot 7, Block 9, Butte Addition to the City of Bozeman, thence westerly along the north line, Lot 7 and Lot 10 of said Block 9 to the NOl'thwest corner of the Lot 18, Block 9. Butte Addition to the CIty of Bozeman; thence southerly along the east line of South Grand Avenue to the Southwest corner of Lot 19, Block 12, said Butte Addition; thence easterly along the south line of Lot 19 and Lot 6 of said Block 12 to the west line of South Willson Avenue; thence northerly along the west line of South Willson Avenue to the p01nt of I beginning. SECTIO~T 3. CHARACTER OF IMPROVEMENTS. Construction of a pavemm t project on West Arthur Street fro~n South Willson Avenue to South Grand Avenue to inclu:Je the construction and installation of combination concreteclFbs and gutters, gravel base course, crushed gravel cushion course, bituminous surface course, and other work incidental thereto. , SECTION 4. ESTIMATE OF COST. The preliminary estimate of cost is t7,520.00, in- cluding all street excavation, all materials, installation costs, engineering and 1nc iden tals. SECTION 5. METHOD )F ASSESSMENT. The preliminary estimate of cost set forth above is to be assessed against the property within said District on an area basis as follows: Costs of the project will be assessed on an area basis, with the first 2S feet of each lot next adjacent to the improvement being recorded at double lts actual area in computing the assessable area of each lot. On this basis the assessable area of the district is 9L,SoO square feet. SECTION 6. ACTUAL AREA OF DISTRICT. The total actual area of all property within Spec ial Improvement Di stric t No. 1~01, exclusive of streets, avenues and alleys, is 81,000 square feet, which is the area on wtlich all protests will be decided. SECTION 7. PAYMENTS. That payments for said improve:aents shall be made 1n twenty (20) annual installments extending over a period of nineteen ( 19) years, but this shall not be construed to prevent payment in full at any reg11lar payment date by any property owner who desires to do so. It is proposed ta pay the entire cost and expense of the construction Bnd installation of said improVements with cash to be obtained ~rom the sale of bonds of said Special Impr~vement District No. ~Ol, as Buth~rized by law. Such bonds will be in denom:tna.tions of ~';lOO. 00 each and fractions or multiples of ~100. 00 where necessary, to be issued and chargeable against a fund to be tmown and designated I as Special Improvement District No. 401 Flmd of the Ci ty of Bozeman. 'rhe bonds will be redeemable at the option of the City, singly or in muldples, and in the order of their rep;lstration, whenever funds are available for thnt Durpose in said Spec.trl Improvemant Di~trict No. 401. Said bonds shall draw a simple interest from the date of their reglstration until called for pa.Tlent, at a rate not to exceed six (6) per cent per annum, which interest shall be chargeable as a part of the cost of construction and instellation of said improvenent. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 191:7, and Hll other applicable provisi.ons of 'ritle 11 of the Revised Codes of Montane, 1947, releting to special improveMent districts in cities and towns, and any arnendmenb3 thereof or thereto. SECTION d. PROTESTS AND NOTICE. That the regular session of the City Commission of the.
