HomeMy WebLinkAboutE5 Mandeville farm blight Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chris Kukulski, City Manager SUBJECT: Resolution 3975 Declaring Mandeville Farm Blighted MEETING DATE: November 6, 2006 BACKGROUND: In conjunction with Resolution 3973 Creating a Tax Increment Financing Industrial District in the area commonly known as Mandeville Farm, said area must be declared blighted per MCA 7-15-4210. MCA 7-15-4210 states that a local governing body shall adopt a resolution finding that: one or more blighted areas exist in such municipality; and the rehabilitation, redevelopment, or a combination thereof of such area or areas is necessary in the interest of the public health, safety, morals, or welfare of the residents of such municipality. The Mandeville Farm properties (City and State lands) should be declared blighted because there are minimal developed services; there is an absence of streets, water, sewer and fire hydrants, thereby lacking infrastructure. Kukulski, City Manager COMMISSION RESOLUTION 3975 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING THAT BLIGHTED AREAS EXIST WITHIN THE MUNICIPALITY AND THE REHABILITATION, REDEVELOPMENT, OR A COMBINATION THEREOF OF SUCH AREA OR AREAS IS NECESSARY IN THE INTEREST OF THE PUBLIC HEALTH, SAFETY, MORALS, AND WELFARE OF THE RESIDENTS OF SUCH MUNICIPALITY. WHEREAS, Mandeville Farm is lacking in infrastructure and services; and WHEREAS, Section 7-15-4210 MCA requires that a municipality adopt a resolution of necessity in order to implement an urban renewal program. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that due to the absence of streets, water, sewer and fire hydrants, the area is determined to be blighted by the following statutory definitions of blight: 7-15-4206 (2) MCA (b) inadequate provisions for ventilation, light, proper sanitary facilities, or open spaces as determined by competent appraisers on the basis of an examination of the building standards of the municipality; (e) defective or inadequate street layout; (n) the existence of conditions that endanger life or property by fire or other causes.
