HomeMy WebLinkAboutE4 Ord 1677 State Lands ZMA Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager SUBJECT: State Lands East Zone Map Amendment MEETING DATE: November 6, 2006 BACKGROUND: On May 16, 2005, the City Commission held a public hearing on a request for an initial zoning designation of a 206± acre parcel located west of Flora Lane, north of Mandeville Lane and east of Interstate 90. The Commission preliminarily approved the proposed zoning designation of “M-1” (Light Manufacturing), directing staff to bring back an Ordinance establishing the initial zoning designations upon annexation of the property. RECOMMENDATION: Adopt Ordinance No. 1677. FISCAL EFFECTS: Fiscal impacts are undetermined at this time. ALTERNATIVES: As suggested by the City Commission Respectfully submitted, _________________________________ ____________________________ Tim Cooper, Assistant City Attorney Chris Kukulski, City Manager Attachments: Ordinance No. 1677 ORDINANCE NO. 1677 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP AND ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "M-1" (LIGHT MANUFACTURING DISTRICT) ON 206 ACRES LOCATED IN SECTION 36, T1S, R5E, GALLATIN COUNTY, MONTANA. WHEREAS, the proposed zone map amendment to grant a zoning designation of "M- 1", Light Manufacturing District, has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on April 19, 2005, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved; and WHEREAS, after proper notice, the City Commission held its public hearing on May 16, 2005, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on May 16, 2005, the City Commission found that the proposed zone map amendment would be in compliance with the City of Bozeman Growth Policy and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as "M-1" (Light Manufacturing District): SW ¼ of Section 36, less the Lewis & Clark Commercial Subdivision, Plat J-376, less Minor subdivision 320, Lot 1 and including Tract 2, COS 1723 and the W1/2, SE1/4 of Section 36, less the Gordon Mandeville State School Section Subdivision, and adjacent rights-of-way, T1S, R5E, PMM, Gallatin County Said tract contains 206 acres, more or less, along with and subject to all easements of record or apparent on the ground. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading. PROVISIONALLY PASSED by the City Commission of the City of Bozeman, Montana, on the first reading at a regular session thereof held on the 6th day of November, 2006 _________________________________ JEFFREY K.
