HomeMy WebLinkAboutResolution 878 Lighting District 400, 1957 , )()1 i....'...,,,_ COMMISSION RESOLUTION NO. 878 A RESOWTION OF THE CITY COlOOSSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 400 FOR THE PURPOSE OF OPERATING AND MAINTAINING A LIGHTING SYSTEM TO LIGHT CYPRESS A VENUE FROM ITS INTERSECTION WITH EAST MAIN STREET TO THE NORTH PROPERTY LINE OF BLOCK D OF MARWYN ADDITION, EAST BABCOCK STREET TO AYLSWORTH A VENUE, AYLSWORTH A VENUE TO EAST CURTISS I STREET AND EAST CURTISS STREET TO THE POINT OF ENDING, SAID LIGHTING SYSTEM TO BE IN- STALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFO~rrTY WITH SECTIONS 11-2245 to 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947, PURSUANT TO AND IN CONFORMITY WITH COlOOSSION RESOLUTION NUMBER 875 OF SAID CITY COMMISSION AS PASSED AND ADOPl'ED BY SAID CITY COMMISSION ON THE 4TH DAY OF DECEMBER 1957 - WHEREAS : The City Commission of the C1.ty of Bozeman, Montana, on the 4th day of December 1957 passed and adopted Commission Resolution No. 875 declaring it to be the intention of said Commission to create a Special Improvement Lighting District No. 400 of said City for the purpose of installing and maintaining a lighting system to light Cypress Avenue, East Babcock Street, Aylsworth Avenue and East Curtiss Street, said lighting system to be installed and paid for by the Montana Power Company, all under the authority of and in conformity with Sections 11-2245 to 11- 2257 inclusive, of the Revised Codes of Montana, 1947, which said Resolution, of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, is hereby referred to for further particulars; and WHEREAS; Due proof has been made that service of notice of the adoption of said Resolution No. 875 was duly made and given as by law provided; and WHEREAS: At the time and place fixed in said Resolution No. 875 for the making and filing of protests against the creation of said proposed Special Improvement Lighting District No. 400, to wit, at the hour of 1:00 o'clock P.M. on Thursday, the 26th day of December 1957, being a regular meeting time of said City Commission, at the Commission Chamber in the City Hall building of the City of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 400; NOV!, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: I Section 1 Creation and Purpose That there be, and there is hereby created a special improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 400, for the purpose of in- stalling and maintaining a lighting system to light Cypress Avenue from its intersection with East Main street to the North Property Line of Block D of Marwyn Addition, East Babcock street to Aylsworth Avenue, Aylsworth Avenue to East Curtiss Street and East Curtiss Street to the point of ending, said lighting system to be installed and paid for by The Montana Power Company, all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Montana 1947, pursuant to and in conformity with Commission Resolution No. 875 of the Commission of the City of Bozeman, passed and adopted on the 4th day of December 1951, which said Commission Resolution No. 875 declares it to be the intention of said City Commission to create said Special Improvement Lighting District No. 400 for the purposes aforesaid, and which said Commission Resolution No. 875 is of record and on file in the office of the Clerk of said City Commission in the City Hall Building, Bozeman, is open to the inspection of the public, and is hereby referred to for further particulars. Section 2 Boundaries The boundaries of said Special Improvement Lighting District No. 400, hereby created, are defined and described as follows: Beginning at the Corner of East Main street and Cypress Avenue, thence south along Cypress Avenue 543.6 feet to the north property line of Block D of the Ma~rn Addition, thence east on East Babcock street to Aylsworth Avenue, thence south on Aylsworth Avenue to East Curtiss Street, thence west on East Curtiss street from the property line common to Lots 6 and 7 of Block B and Lots 3 and 4 of Block C, all of Marw,yn Addition to the point of ending, the same being the I east corner of the intersection of the County Road commonly known as Golf Way leading in a southeasterly direction and East Curtiss Street. Section 3 Character of Improvements The character of the improvement to be made in said Special Improvement Lighting District No. 400 to be installed and paid for by The Montana Power Company is the erection and installation of 12 luminaries with 6,000 lumen lamps mounted approximately 30 feet high on wood poles. Power is to be fed by a single overhead wire, and the installation shall ~" equipped with all necessary appliances for the safe and proper operation of the system. ~yy) l~(",lf....I Section 4 Frontage of District, Estimate of Cost of Maintenance and Electrical Current and Method of Assessment The estimate of the cost of maintaining such lighting system and supplying current therefor is the S1Jm of Three Hundred Thirty-Two and 64/100 Dollars ($332.6h) per year, of which total seventy- five per cent (75%) is to be assessed against the property within the district on a front foot I basis, a11d twenty-five per cent (25%) is to be paid by the City of Bozeman. The estimated rate of assessment per year per front foot of the property within the district is $.053633 per front foot. The total actual frontage of the property within said proposed Special Improvement Lighting District No. hoo is 4651.63 front feet. Section 5 Pa;yment Special Improvement Lighting District No. hoo is established for the purpose of paYing the operating and maintenance cost of such lights only which said operation and maintenance will in- clude the furnishing of electric current, all lamps as needed, and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne by the Montana Power Company. The portion of the cost of maintenance and electrical current payable by the City of Bozeman will be paid directly by the City of Bozeman and the portion to be assessed against the property wi thin the district will be assessed and paid annua.lly as provided by law.
