COMMISSION RESOWTION NO. 876
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT
TO BE THE INTENTION OF SAID COMHISSION TO ABANDON CITY OF BOZEMAN SPECIAL IMPROVE-
MENT DISTRICT NO. 72 AND TO ABANOON THE MAINTENANCE OF STREET PARKINGS THEREUNDER,
AND DIRECTING THE CLERK OF THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION,
ALL PUHSUANT TO THE STATUTES IN SUCH CASES MADE AND PROVIDED
WHERF~S, a Petition was filed with the City of Bozeman on December 2, 1957, by owners of I
property in Special Improvement District No. 72 of the City of Bozeman, praying for the abandon-
ment of said District, and
WHEREAS, it appears for the best interests of the City of Bozeman and the property owners
within said Spedal Improvement District No. 72 that said District be abandoned.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
SECTION 1. DECLARATION OF INTENTION. It is hereby declared to be the intention of the City
Commission of the City of Bozeman, Montana, to abandon Special Improvement District No. 72 of
said City and to abandon the maintenance of any street parking improvement therein.
SECTION 2. BOUNDARIES OF DISTRICT. The boUndaries of said Special Improvement District No.
72 are as follows:
Beginning at the center of the intersection of College Street and Grand Avenue;
thence north along the center line of Grand Avenue to the projection of the line
between lots 6 and 7 in Block 10. Fairview AddUion; thence west along the line
between lots 6 and 7, 14 and 15 in Block 10. Fairview Addition; lots 7 and 8 in
Block 45, Park Addition; lots 7 and 8, 17 and 18 in Block 46, Park Addition; lots
7 and 8. 17 and 18 in Block 47, Park Addition. lots 7 and 8, 17 and 18 in Block 48,

Park Addition, tc the center line of Seventh Avenue; thence south on the center line
of Seventh Avenue to a point 165 feet south of the south line of College Street;
thence east on a line 165 feet south of and parallel to the south line of College
street to the center line of Grand Avenue; thence north on the center line of Grand
Avenue to the place of beginning; which said property, situated within said boundaries,
is hereby declared to be especially benefited by the special improvements hereinafter I
described.
SECTION 3. BENEFITS DECLARED. It is hereby declared by the Commission of the City of
Bozeman that all of the land within the boundaries of said Special Improvement District No. 72
will be specially benefited by such abandonment and that it is to the best interests of the City
of Bozeman and the owners of property within the said District that the District be abandoned.
SECTION h. EFFECTS OF ABANroNMENT. Should said Special Improvement District No. 72 be
abandoned in conformance to this Resolution and the Notice to be published pursuar~ thereto, it
shall be the duty of the owners of the property abutting on the property involved to maintain the
same after such abandonment, and such abandonment shall not relieve said property owners from the
assessment and payment of a sufficient amount to liquidate all charges existing against said
District pri.or to the date of abandonment.
SECTION 5. TIME FOR PROTESTS. That the regular session of the City Commission of the City
of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Thursday,
the 26th day of December, A.D. 1957, at the hour of 1:00 o'clock p.m. of said day, are the time
and place when and where the City Commission will hear and pass upon all protests duly and
regularly made and filed against the abandonment of said proposed Special Improvement District No.
72.
SECTION 6. CLERK TO GIVE NOTICE. That the Clerk of the Ci.ty Commission be, and he is hereby
directed to give notice in the manner and for the time as by law required, of the adoption of this
Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a stated and regular session of
said Commission held on the 11th day of December, A.D. 1957.

COMMISSION RESOLUTION NO. 876 OF THE CITY OF BOZEMAN DECLARING THE INTENTION OF
THE CITY OF OOZEMAN TO ABANDON SPECIAL IMPROVEMENT DISTRICT NO. 72
Notice is hereby given that on the 11th day of December, A.D. 1957, at a regular session of
the Commission of the City of Bozeman, Commission Resolution No. 876 entitled:

was passed and adopted.
That the boundaries of said Special Improvement District No. 72 are as follows:
Beginning at the center of the intersection of College Street and Grand Avenue;

Street to the center line of Grand Avenue; thence north on the center line of Grand
Avenue to the place of beginning; which said property, situated within said boundaries,
is hereby declared to be especially benefited by the special improvements hereinafter
described.
That Thursday, the 26th day of December, A.D. 1957 at one o'clock P.M. at the Commission
Room of the City Hall, Bozeman, Montana, is the date, time and place set for the hearing of
protest against the abandonment of said Special Improvement District No. 72 and for the passage
of the Resolution of abandonment.
That unless forty (40) percent of the property owners of said Special Improvement District
No. 72 file written protests with the Clerk of the City Commission before the above specified
date and time. a Resolution of abandonment of said Special Improvement District No. 72 will be
I by the City Commission passed.
That should said Special Improvement District No. 72 be abandoned in conformance to this
Resolution and the Notice to be published pursuant thereto, it shall be the duty of the owners
of the property abutting on the property involved to maintain the same after such abandonment,
and such abandonment shall not relieve said property owners from the assessment and payment of
a sufficient amount to liquidate all charges existing against said District prior to the date
of abandonment.
This notice is given pursuant to the provisions of Chapter 38 of the Laws of the 32nd
Legislative Assembly, State of Montana.
