Epple, AICP, Planning Director Chris Kukulski, City Manager SUBJECT: Alder Creek Subdivision, Phase Three and Four Request for One-Year Extension, Planning Application No. #P-03010 MEETING DATE: Monday, October 2, 2006 CONSENT AGENDA ITEM BACKGROUND: Mahar Montana Homes, L.L.C., represented by Matthew Cotterman of C & H Engineering and Surveying, Inc., has requested a one-year extension of preliminary plat approval for Alder Creek Subdivision,Phase I-IV, Planning Application No. P-03010. On June 2, 2003, the Bozeman City Commission granted conditional approval of the Alder Creek Subdivision, Phase I-IV, a 251-lot residential major subdivision. The applicant's request, is to grant a one-year extension of the preliminary plat in order to complete the infrastructure and street improvements for Phase 4 and 5 of the major subdivision. Under Section 18.06.040.D.6 of the City of Bozeman Unified Development Ordinance, the City Commission may, at the request of the subdivider, extend its three-year preliminary plat approval for one (1) additional calendar year. The Development Review Committee has considered the applicant's requested and based on the information provided by Mr. Cotterman found that the granting of a one-year extension would not influence conditions of preliminary plat approval nor the primary criteria for consideration of subdivisions established in Title 76-3-608, M.C.A. As a result, the Planning Office recommends approval of said request and requests that this item be placed on the October 2, 2006, consent agenda of the City Commission. UNRESOLVED ISSUES: There are no unresolved issues at this time. RECOMMENDATION: That the City Commission approve the applicant's request for a one-year extension of preliminary plat approval for Alder Creek Subdivision,Phase Three and Four. FISCAL EFFECTS: Fiscal impacts are undetermined at this time, but will include increased property tax revenues, along with increased costs to deliver municipal services to the property, when the property is developed. Box 1230 Bozeman, MT 59771-1230 RE: Alder Creek Subdivision,One year Preliminary Plat Extension Request(04770) Dear Dave, On behalf of Mahar Montana Homes,LLC we respectfully request that the City Commission extend the preliminary plat approval for Alder Creek Subdivision by one year. The subdivision was granted preliminary plat approval by the Commission on June 2, 2003. The extension is required to finalize the infrastructure improvements for Phases 4 and 5. The developer has diligently worked through the first three phases of the subdivision and C&H Engineering and Surveying is currently finalizing the construction plans for Phases 4 and 5. Infrastructure improvements for Phases 4 and 5 are scheduled for concurrent construction this summer or early next spring depending on contractor availability and weather conditions. Phases 4 and 5 are the final two phases of Alder Creek Subdivision. Please let me know if you need any additional information to get this request before the City Commission. Sincerely, Matthew B.
