COMMISSION RESOLUTION NO. 871
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY
OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 31 A~m TO ABANDON THE
MAINTENANCE OF STREET PARKING THEREUNDER, AND DIRECTING THE CLERK OF
I THE CITY COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL PURSUANT
TO THE STATUTES IN SUCH CASES MADE AND PROVIDED.
WHEREAS, a Petition was riled with the City of Bozeman on November 12, 1957,
by owners or property in Special Improvement District No. 31 or the City or
Bozeman, praying for the abandonment of said District, and
WHEREAS, it appears for the best interests of the City of Bozeman and the
property owners within said Special Improvement District No. 31 that said
District be abandoned.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
SECTION 1. DECLARATION OF !NTENTION. It is hereby declared to be the
intention of the City Commission of the City of Bozeman, Montana, to abandon
Special Improvement District No. 31 or said City and to abandon the maintenance
of any street parking improvements therein.
SECTION 2. BOUNDARIES OF DISTRICT. The boundaries of said Special
Improvement District No. 31 are as follows:
Beginning at a point in the center line of West Babcock" Street where
the same is intersected by a line sixty (60) feet east of the east
line of Black Avenue South; Thence south parallel with said Black
Avenue South to the center of West COllege Street; Thence west to a
point sixty (60) feet west of the west line of said Black Avenue
South; Thence north parallel with said Black Avenue South to the
center of West Babcock Street; Thence east to the place of beginning.
SECTION 3. BENEFITS DECLARED. It 1s hereby declared by the Commission of
I the City of Bozeman that all of the land within the boundaries of said Special
Improvement District No. 31 will be specially benefited by such abandonment and
that it is to the best interests of the City of Bozeman and the owners of
property within the said District that the Distrlct be abandoned.
SECTION 1+. EFFECTS OF ABANDONMENT. Should said Special Improvement District
No. 31 be abandoned in conformance to this Resolution and the Notice to be pub-
lished pursuA.nt thereto, it shall be the duty of the owners of the property
abutting on the property involved to maintain the same after such abandonment, and
such abandonment shall not relieve said property owners from the assessment and
payment of a suf'ficient amount to liquidate all charges existing against said
District prior to the date of abandonment.
SECTION 5. TIME FOR PROTESTS. That the regular session of the City Commission
of the City of Bozeman to be held at the Commission Chamber, City Hall Building,
Bozeman, Montana, on Wednesday, the 18th day of December, A.D. 1957, at the hour
of 1:00 o'clock p.m. of said day, are the time and place when and where the City
Commission will hear and pass upon all protests duly and regularly made and riled
against the abandonment of said proposed Special Improvement District No. 31.
SECTION 6. CLERK TO GIVE NOTICE. That the Clerk of the City Commission be,
and he is hereby directed to give notice in the manner and for the time as by
law required, of the adoption of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a stated and
regular session of said Commission held on the 27th day of November, A.D. 1957.

Notice is hereby given that on the 27th day or November, A.D. 1957, at a
regular meeting of the Commission of the City of Bozeman, Commission Resolution
No. 871 entitled:

That the boundaries of said Special Improvement District No. 31 are as
follows:
Beginning at a point in the center line of West Babcock street where
the same is intersected by a line sixty (60) feet east of the east
line of Black Avenue South; Thence south parallel with said Black
AVenlre South to the center of West College street; Thence west to a
point sixty (60) feet west of the west line of said Black Avenue
South; Thence north parallel with said Black Avenue South to the
center of West Babcock Street; Thence east to the place of beginning.
That Wednesday, the 18th day of December, A.D. 1957 at one o'clock p.m.
at the Commission Room of the City Hall, Bozeman, Montana, is the date, time
and place set for the hearing of protest against the abandonment of said
Special Improvement District No. 31 and for the passage of the Resolution of
abandonment.
That unless forty (40) percent of the property owners of said Special
Improvement District No. 31 file written protest with the Clerk of the City
Commission before the above specified date and time, a Resolution of abandon-
ment of said Special Improvement District No. 31 will be, by the City Commission
passed.
That should said Special Improvement District No. 31 be abandoned in
conformance to this Resolution and the Notice to be published pursuant thereto,
it shall be the duty of the owners of the property abutting on the property
involved to maintain the same after such abandonment, and slwh abandonment
shall not relieve said property owners from the assessment and payment of a
sufficient amount to liquidate all charges existing against said District
prior to the date of abandonment.
This notice is given pursuant to the provisions of Chapter 38 of the I
Laws of the 32nd Legislative Assembly, State of Montana.
