WHEREAS, the City Comrnission of the Clt7 of Bozeman did on the 8th day of January, 1940, duly and regularly pass Ordinance no. 696, entitled: AN OPDINANCE DEFINING GARBAGE }'OR 'rim P1JRPOSE UB' THIS ORDINANCE, PROVIDING FOR 'rIlE COLLECTIUN AND DISPOSITION 'rHEREOI" BY AND UNDER rrHE SUPERVISION AND CON'rROL UF 'I'HE DEPAR'rrJIENT OF PUHLIC WELI"ARE AND FOR DEFRAYING 'PEE COST OF SUCH COLLEcrrrON AND DISPOSITION BY SPECIAL ASSESSMENT AGAINS'r 'rHE PROPERTY TO WHICH SUCH SERVICE IS RENDERED, AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE, which Ordinance No. 696, passed as aforesaid 1s herebv referred to Bnd made a Dart of this Resolution for further particulars in respect to the basis and method \)f assessing the cost against the property herein assessed, and W'HERF..AS, said expense Incl~red by ~aid City in the collection and disposltton of garbage in accordance with said Ordinance is hereby estimated by the Commission of the City of BozemeD to be the sum of thirty nine thousand nne hundred ninety throe dollars and seventy four cents ($39,193.74) for the year 1957, over and above all moneys collected froM business and professional concerns, or combined residence and business or residences and professional business concerns in accordance wi th said Ordinance No. 6~)6, and WHERF~S, in order to raise said sum to defray the said cost, it is necessary to establish the baste unit rate as defined in said Ordinance No. 696 at Twelve Dollars (~12.00). NOW, 'THEREFORE, pl~suant to the provisions of said Ordinance No. 696, and the laws of the State of Montana, 3E IT RESOLVED AND IT IS HEREBv ORDERED BY THE COMMISSION OF 'rHE CITY I l)F EO ZEMAN, STATE OF' MON'rANA: Section 1. That to defray the estimated cost and ~xpense of collecting and disposing of garbage in the City of Bozeman for the year 1957, there is hereby levied and assessed against the pr~perty and the several lots, pieces and parcels of land thereof wi thin the City of Bozeman as set forth in Schedu.le "A", which is attached hereto and made a part hereof, a tax; that a particular description of each lot and parcel of land with the name of the owner and/or owners and the sum assessed against the same is set forth in the assessment list in said Schedule "A"; that the several sums set opposl te the names of said owners and. the described lots and parcels of land, be, and the Same are hereby ~evied and assessed upon and against said lots and parcels of land for said purpose; that the several sums be collected from the respective owners of said lots and pnrcels of land described in said assessment list and owned by them; that the said sums shall be paid and the collection thereof be made in the manner and in accordance with Ordinance No. 696 of the City of Bozeman, Montana, and the laws of tho State of Montana govern- ing the collection of special improvement taxes; that failure to pay such assess- ment when the seme shall bec.)me due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Sect.ion 2. That the regular session of the Commission of the City of Bozeman, Montana, to be held in the Commission Chamber in the CIty Hall of said City on the 16th day of October, 1957, at 1:00 o'clock P.M. be, and the same is hereby desig- nated as the time and place a't which objections to the final adoption of this Resolution will be heard by said COMmission. Section 3. That the Clerk of the Com.mlssion of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chron:J.cle, 8 daily newspaper nrinted and published in said City of Boze~an, a notice signed by the Clerk of the Commission, statinG that a resolution levying and assessing a special I assessment of taxes to defray the cost and expense of the collection and disposi- tion of garbage in the City of Bozeman for the year 1957, against the property to which such service was rendered, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; and that said Notice shall be pUblished at least five days before the date set by the Commission for hearing of objections and the final adoption of this Resolution. --'-.- -...- ~)n') f"" .;...,; Provistonally passed and adopted by the Commission of the City of Bozeman at a regular session thereof held on the 9th day of October, 1957. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 9th day of October, 1957, Cocrmission Resolution No. 867 was provisionally passed and adopted; thRt said Resolution levies and assesses a special assessment of taxes to defray the cost of collection and dis- position of garbage in the City of Bozeman, for the year 1957, upon all property to wh:i.ch such service was rendered. That said Commission Resolntion No. 867 is now on [ile in the office of the Clerk of the Commission of the City of Bozeman, subject to inspection of all persons interested, for f1 period of five days; that Wednesday the 16th day of October, 1957, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, in the Commission Room, in the City Hall Building, has been designated as the time and place when I and where said Commission will hear and pass upon B::1Y 8.nd all objections that may be made to the final passage and adoption of said Commiss1on Resolution No. 867 and the levying of said assessment; and that said Resolution will be finally passed nnd adopted at said reGular session of said CommissiorJ, subject to such corrections and amendments that may be made upon obje~tions made and filed with the Clerk of the Commission within the five days limit as provided by law.
