WHEREAS, the City Council of the City of Bozeman heretofore duly and regularly passed Ordinance No. 1~28, entitled: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES", and WHEREAS, Section 11-985 R.C.M. 19h7, provides the City or Town Council has power to declare and determtne what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which they shall be exterminated, and to require the owner or owners of any property within said City or Town, to exter- minate or remove noxious weeds from their premises, and one-half of any road or street lying next to the lands or boulevard abutting thereon, and to provide, in the event the owners or owner of any of said premises neglect to exterminate or remove noxlous weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and WHEREAS, owners of premises in said City have neglected to exterminate and remove noxious weeds therefrom durinft the year 1957 and the City of Bozeman, pursuant to Section 11-985 R.C.M. 19.\-7, and Ordinance No. 1-!-28 , have exterminated and removed noxious weeds from the premises of said o\vners and the total cost of the extermination and renoval thereof is char~eable to the property as hereinafter set forth4 pursuant to the provisions of said Section 11-985, Political Code, R.C.M. 19 7, and said Ordinance No. h28; BE IT RESOLVh"'D AND IT HEREBY ORDERED BY 'rHE COMMISSION OF THE CITY OF BOZm~AN, STATE OF MONTANA: Section 1. That during the year 1957, the City of Bozeman has exterminated and removed noxious weeds from properties in the City of Bozeman and defrayed the cost thereof as set forth in Schedu1~ hereto attached and made e part hereof. I Section 2. That to defray the cost ($190.95) of exterminating and removing said noxious weeds from said premises as set forth in said schedule, hereto attached and made a part hereof, for the year 1957, there be, and there is hereby levied and assessed a special tax against said property as set forth in said schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land with the name of the owner ana the sum assessed against him or it is set forth in assessment list hereto attached marked "Schedule One", and made a part hereof; that the several sums set opposite the names of the owners anQ the descrip- tion of the lots a~d parcels of land be, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the resDective owners of said lots and parcels of land described in said assessment list, tlSchedule One", as required by law; that said sums shall be paid and the collection thereof shall be made in the manner in accorda1ce with the law governing the collection of speciel improvement taxes; that failure to pay such assessments when same shall become due and payable shall make such persons and 3uch lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be held on the 9th day of October, 1957 at the Commission Room, City Hall Build- ing, be and the same is hereby designated as the time and place at whlch objections to the final adoption of this Resol ution will be heard by the Commiss~.on. Section 1~. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, stating that a resolution levying a special asseSsMent of taxes to defray the cost of exterminating and removing noxious weeds from certain properties in the City of Bozeman for the year 1957, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said notice shall state the -I time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five days before the date set by the Commission for hearing of objections, and the final adoption of this resolution. B66 LEVYING SPECIAL ASSESSMENT OF TAXES TO DEFRAY THE COST OF EXTERMINATING AND REMOVING NOXIO\JS WEEDS ON CERTAIN PROPERTIES IN 'rHE CITY OF BOZEMAN FOR THE YEAR 1957. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 2nd day of October, 1957 Commission Resolution No. 866 was duly passed and adopted; that said Commission Resolution No. 866 levies and assesses a spectsl assessment of taxes upon certain properties in the City of Bozeman for the year 1957 to defray the cost of exterminating and removing noxious weeds for the year 1957. That, SR.id Cor.nnission Resolutirm No. 866 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five days; tt,.8t Wednesday the 9th day of October 1957, at 1:00 o'clock P.M., of said day at a regular session of the Commission of the City of Bozeman, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon BnJT and all objections that may be made to the final passage and adoption of said Commission Resolution No. 866 and the levying of said assessment; that, said Resolution will be finally passed and adopted at said regular session of said Commission subject to such I corrections and amendments as may be made upon objections made and filed witQin the five days limit as provided by law.
