I WHEREAS, the streets within the boundaries of said street Sprinkling Distr1cts have been sprinkled during the year 1957, as contemplated in said Resolutions, in accordance with the terms and conditions thereof; end WHEREAS, the Street Sprinkline Districts and the Resolutions creati~e the same, the total frontage of the property within said district to be assessed, the tntal cost of said sprinkline within said districts and the proportion thereof chargeable to the property therein 1s hereinafter set forth. NOW THEREFORE, cm.suant to the provisions of Section 11-2263 to 11-2267 inclusIve, R.C.M., 19 7 and Ordinance No. 295 and said Council find Commlssl')n Resol1J.tLms creating sald Street Sprinkline Districts; BE rr RESOLVED AND IT IS EEREBY ORDERED BY T1--!g COM1USSION DF THE CITY OF BOZEMAU, STA'rE OF MONTANA: Section 1. That for the year 1957, the City of Bozeman has waived the sprinkling assessments of all Street SprinklinG Districts except street Sprinkling District No.1; that for the year 1957, the City of Bozeman has defrayed the cost ($1720.51) of sprinkling streets in the several street sprinkling districts pursuant to Resolutions creating the same, and seventy-five percent I)f the entire cost there- of ($1290.38) exclusive of the cost of sprinkling parks and public places, the total number ,)f linear fe et of property to be e 1'; ,90S sed, and the ra te per linear foot, is as follows: Sprinkling District No.1, created by COlmci1 Resolution No. 424!, Main Street from Wallace Ave. to Fourth Ave., ~ total frontage of 9355.9 feet, the sum of $1290.38, being 75% of the enttre amount, or at any approxi- mate rate per front foot of $0.137921526. Section 2. That to defray seventy-five percent ()f the cost of sprinling I streets within said street sprinkling districts for the year 1957, there be, and there is hereby levied and assessed a tax, upon all property in front of and bordering on said street sprinkltng districts as set forth in Schedule One hereto attached and ~ade a part hereof; that 8 partlcular description of each lot and parcel of lanrl with the name of the owner and the SUJ11 aS3essed against him or it; is set forth in the assessment lists hereto attached, marked Schedule "One" and made a part hereof; that the several s 1J.n1.S set oppos i te the names of the owners, and the described lots and parcels of land he, and the same are hereby levied and assessed upon and against said lots and parcels of land; that the several sums be collected from the respecti"e owners of said lr)ts and parcels of land described in the said assessment lists, Schedule One, as required by law; that said sums shall be paid and the collect::ton thereof shall be made in the manner anli in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and such. 1C1ts ancl :parcels of land liable to, the penalties provided by law relative to delinquent taxes. Section 3. That the regular session of the Commission of the City of Bozeman to be held on the 2nd day of October, 1957, at the Commission Chamber, City Hall BUilding, be, and the same is hereby designated as the time and place at which ::>bjections to the final adopt:1on of this Resol1ltion will be heard by the Commission. Section l~. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a Reso111tion levyins R special assessment of taxes to defray seventy-five per cent of the cost of sprl~kling streets in the said street Sprinkling Districts for the year 1957, is on file in the office of the Clerk of the Commission, subject to inspectton for" E: period of five days; that said Notice shall state the time and place at which objections will be heard by I the Commlssion to the final adoption of this ResolutLon; that it shall be published at least five days before the date set bJT the Commission for hearing objections, and the final adoption of this Resolution. Provisionally passed and ad()pted by the Commission of the City of Bozeman at an adjourned regular session thereof held on the 27th day of September, 1957. NOTICE IS HEREBY GIVEN, that at an adjourned regular session of the Commission of the City 0f Bozeman held on the 27th day of September, 1957, Commission Resolution No. 864 was duly passed and adopted; that said Commission Resolution No. 86tl levies and assesses a special assessment of taxes upon all the property in Street Sprink- ling Districts of said City to defray seventy-five percent of the cost of sprinkling streets within said Street S9rinkling Districts for the year 1957. That said Street Sprinkling Districts, and the Resolutions creating the same and the am0unt of the assessments are as follows: street Sprinkling District N0. 1, created hy Resolution No. 1!-24)'. in the amount of $1,290.38. 8' Tha t said Resolution No. 86h is now on file in the off'ice of the Clerk of the ComJnission of said City of 30zeman subject to inspection of all persons interested for a period of five days; that Wednesday, the 2nd day of October, 1957, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, COmJnission Room, City Hall Building, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final adoption of said COmJnission ResolutIon No. 864, and the levying of said assessment; and that said Resolution will be finally passed I and adopted at said regular session of said Co~,ission, subject to such corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
