The Commission of the City of Bozeman met in the Community Room, Gallatin County
Courthouse, 311 West Main Street, on Tuesday, September 11, 2006, at 3:00 p.m.
Present were Mayor Jeff Krauss, Cr. Sean Becker, Cr. Jeff Rupp, Cr. Kaaren Jacobson,
Acting City Manager Debbie Arkell, Planning Director Andy Epple, Assistant Planning
Director Chris Saunders, City Attorney Paul Luwe, and City Clerk Brit Fontenot.

Mayor Krauss called for public comment

Kory Ravniss resides at 2066 Stadium Drive and opposes any interim zoning ordinance.

Brian Caldwell resides at 733 South Tracy and is not associated with Gobuild.

Joby Sabol represents Linda Holland, owner of Bridger View Trailer park and brought
forth two points.
1. County's TDR proposal in part entails situation where density rights could be
purchased.
2. There have not been many mobile home parks proposed and only a few in the county
but a sizable one proposed near the airport.

Present were Mayor Jeff Krauss, Cr. Sean Becker, Cr. Jeff Rupp, Cr. Kaaren Jacobson,
Acting City Manager Debbie Arkell, Planning Director Andy Epple, Assistant Planning
Director Chris Saunders, City Attorney Paul Luwe, and Deputy City Clerk Stuart
Bernard.

Mayor Krauss called the meeting to order at 6:00 PM.

1:50:08 [22:03:13] D. Public Service Announcement - D.A.R.E. Officer Bryan
Adams sang the National Anthem in memory of 9-11.
1:51:50 Declaration of American Indian Heritage Day
Mayor Krauss declared September 22, 2006 and henceforth the fourth Friday of
September to be American Indian Heritage Day.

1:54:21 [18:01:24] Motion and Vote - It was moved by Cr. Becker, seconded by Cr.
Rupp, to approve the August 28, 2006 linked minutes.
Those voting Aye being Crs. Becker, Rupp, Kirchhoff, Jacobson, and Mayor
Krauss.
Those voting No being none.
The motion carried.

1. Authorize payment of claims (LaMeres)
2. Ratify City Managers signature on Professional Services Agreement for Planning
Services with Tindale-Oliver and Associates (Saunders)
3. Approve Vacancy Mitigation Plan submitted by Stoneridge Square as required in
section 18.40.180 (Kozub)

Commissioner asked for clarification regarding consent item F3.

Mayor Krauss called for public comment on consent items 1 - 3. No person commented.
1:56:24 [18:11:00] Motion and Vote - It was moved by Cr. Rupp, seconded by Cr.
Kirchhoff, to approve Consent items F1-3
Those voting Aye being Crs. Becker, Rupp, Kirchhoff, Jacobson, and Mayor
Krauss.
Those voting No being none.
The motion carried.

Mayor Krauss called for public comment. This was the time for individuals to comment
on matters falling within the purview of the Bozeman City Commission. There will also
be an opportunity in conjunction with each agenda item for comments pertaining to that
item.
1:57:25 [18:11:40] Public Comment - Kristen Drost
Kristen Drost resides at 510 W Dickerson Street and commented about her recent
accident at the intersection of Main and Church Streets.
1:59:04 [18:12:03] Acting City Manager Debbie Arkell provided additional information
about the possibility of a light at the intersection of Main and Church Streets.
2:00:10 [18:12:41] Public Comment - Ken Kraft
Ken Kraft of 702 Bridger Drive spoke of how the trailer park sale could hurt citizens.

Mayor Krauss mentioned the Hazardous Materials response to a situation in Gallatin
Canyon and commended City staff.

Assistant Director of Planning Chris Saunders presented the staff report.
2:23:01 [18:19:42] Mayor Krauss asked City Attorney Paul Luwe about legal
requirements regarding interim ordinance passage.

Mayor Krauss called for public comment.
2:25:42 [18:33:56] Public Comment - Kory Ravniss
Kory Ravniss resides at 2066 Stadium Drive and is one of the designers for the Story Mill
development that will be replacing the trailer park.
2:30:53 [18:38:06] Public Comment - Dennis Kidder
Dennis Kidder resides at 890 Hidden Valley Road and as a previous resident of the
mobile home park requested that the relocation plan be brought forward and found
acceptable to the affected parties.
2:33:19 [18:38:48] Motion - It was moved by Cr. Kirchhoff and seconded by Cr.
Jacobson approve the Interim Zoning Ordinance as drafted by staff.

Zoning Ordinance as presented by staff.]
Mayor Krauss clarified the motion to include that there is urgency of need, as
required by code 76.2.306.
Those voting Aye being Crs. Rupp and Kirchhoff
Those voting No being Crs. Becker, Jacobson, and Mayor Krauss.
The motion failed 2-3.

Assistant Planning Director presented the staff report.

The applicant, Mike Delaney, thanked the Commissioners and Staff. He then discussed
how mixed use would be ideal for the current business park zoning.

Cr. Becker sought clarification on some points from Mr. Delaney's presentation.

Mike Delaney presented a letter from Mike Basile of Prudential Reality.

Connie Garrett resides at 414 N. Plum and quoted from a book in support of Mixed Use
Zoning.

Lowell Springer resides at 3207 Augusta Drive and spoke in support of a smaller acreage
requirement for mixed use districts.
4:59:38 [20:36:37] Public Comment - Ileana Indreland
Ileana Indreland resides at 101 East Main and commented that mixed use is allowable in
existing zoning areas.

City-County Meeting Friday 15, 2006 7:00 at the Community Room in the County
Courthouse.

Commissioner Kirchhoff noted that he will not be at the Friday meeting.

Forest Service and the City are hosting an Open House from 4:00 pm to 8:00 pm
regarding Bozeman Municipal Watershed Forest Management Program

Commissioner Rupp requested to add an agenda item regarding Wastewater Treatment
Plant permit. He also discussed the question of reclaiming to itself the final approval of
Lincoln Park Condominiums

Commissioner Jacobson requested the status of 2020 plan update.
