WHEREAS: There has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of' certain owners of' properties situated on North Eighth Avenue lying between West Main Street and West Mendenhall Street in said City asking that a special improvement district be created for the purpose of constructing and installing a pavement project to include the construc- tion and installation of combination curbs and gutters, gravel base course, crushed gravel cushion course, bituminous surface course, and other work incidental there to; and WHEHEAS: That at a regular meeting of the City Commission of the City of Bozeman held on the 24th day of July, 1957, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF ~{E CITY OF B02EMAN: Section 1 Declaration of Intention, That it is hereby declared to be the intention of the City of Bozeman to craa te a special improvement district to be knovm and designa ted as Spectal Improvement District No. 399 of the City of Bozeman for the purpose of construct- ing and installing a pavement project on North Eighth Avenue lying between West Main Street and West Mendenhall Street, said pavement project to include the I construction and installation of combination curbs and gutters, gra ve 1 bD se course, crushed gravel cushion course, bituminous surf'ace course, and other work incidental thereto. Section 2 Boundaries The boundaries of said Special Improvement District No. 390 are described as follows: Beginning at a point on the southerly llne of West Main Street, said point being 125 f'eet eas t of the eas t line of North Eighth Avenue, thence in a nortrerly direction, 125 feet east of and parallel to the east line of' North Eighth Avenue to the s011th lIne of West Mendenhall Street; thence in a westerly direction along the south line of West ~endenhall Street to a point 125 feet west of the west line of North Eighth Avenue; thence in a southerly direction, 125 feet west of and parallel to the west line of' North E:lghth Avenue to a point on the north line of West Main Street; thence in an easterly direction along the north line of West Main Street to the point of beginning_ Section 3 Character of Improvements Construction of a pavement project on North Eighth Avenue between West Main Street and West Mendenhall Street to include the construction and installation of' combination concrete curbs and gutters, gravel base course, crushed gravel cushion course, bituminous surface course, and other work incidental thereto. Section 4 I Estimate of Cost The preliminary estimate of cost 1s $8,680.00, including all street exca va ti on, all ma ter'fa Is, installation costs, engineering and incidentals. Section 5 Method of Assessment The preliminary estimate of cost set forth above is to be assessed against the property within said District on an qrea basis 99 follows: 17:3 Costs of the project will be assessed on an area basis, with the first 25 feet of each lot next adjacent to the improvement being recorded at double its actual area in computing the assessable area of each lot. On this basis the assessable area of the district is 84,000 square feet. Section 6 Actual Area of District I The total actual area of all property within Special Improvement District No. 399, exclusive. of streets, avenues and alleys, is 70,000 square feet, which is the area on which all protests will be decided. Section 7 Payments That payments for said improvements shall be made in twenty (20) annual install- ments extending over a period of nineteen (19) years, but this shall not be construed to prevent pa~~ent in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construc- tion and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 399, as authorized by law. Such bonds will be in denominations of $100.00 each and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 399 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in ~ultiples, and in the order of thelr registration, whenever funds are available for that purpose in said Special Improvement District No. 399. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six (6) per cent per annum, which interest shall be chargeable as a part of the cost of con- struction And installation of said improvement. The bonds will be issued and sold in accordanco with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana 1947, relating to $pecial l~provement districts in cities and towns, and any amendments thereof or thereto. Section 8 Protests and Notice I That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 21 at dB y of A~ust , 1957, a t the hour of one 0' clock P. ~~. of sa Id day, are the time an place, when and where the city commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 399, the improvement proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of tbe City Commission be, and he is hereby, directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of In ten tioD. That Wednesday the 21st day of August, A.D. 1957, at one o'clock P.M. at the Conmdssion Room of the City Hall, Bozeman, ~."ontana, is designated by said Resolu- tion No. 854 as the time and place for hearing objections to the action proposed to be taken by said resolution, and when and where any and all persons whose pro- perty is within said Proposed Special Improve~ent District No. 399 on that portion of North Eighth Avenue lying between West Main Street and West Mendenhall Street in said City may appear and show cause, if any they have, against said proposed improvement. Objections must be made in writing and filed with the Clerk of the City Commission not later than fifteen (15) days after date of the first publi- cation of this Notice. An approxima te prelim}.nary estlma te of the cost of doing such work and making such improvements within said District, ircludlng all street excavation, all materials, inst8llation costs, engineering and incidentals, which is to be specially assessed against the property within said District is $8,680.00. The total assessable area of all property within the said District exclusive of streets, avenues and alleys with the 25 feet adjacent to the improvements taken at double its actual area 1s 84,000 square feet. Property immediately ad,jacent to and within 25 feet of the proposed improvement is to be assessed at double the aAseSSrr'ent against other property in the District. Payment for the improvements is to be made in twenty (2U) annual instRllments over a period of nineteen (19) years with interest on the deferred pa~rments not to exceed six (6) per cent per annum, payable annually, but this shall not be construed to prevent payment in full at any regular payment date by any property owner.
