COMMISSION RESOLUTION NO. 849
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
ABANDONING CITY OF BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 256 AND
ABANDONING ~{E MAINTENANCE OF STREET PARKINGS THEREUNDER, PURSUANT
TO AND IN CONFORMITY vITTH COMMISSION RESOLUTION NO. 843 AS PASSED
AND ADOPTED BY SAID CITY COMMISSION ON THE 12TH DAY OF JUNE, A.D.
1957.
WHEREAS, The City Commission of the City of Bozeman on the 12th day of I
June, A.D. 1957, passed and adopted Commission Resolution No. 843 declaring
it to be the intention of said Commission to abandon City of Bozeman Special
Improvement District No. 256 and to abandon the maintenance of street parkings
thereunder, which said Resolution, of record and on file in the office of the
Clerk of said City Commission and open to the inspection of the public, is
hereby referred to for further particulars; and
VffiEREAS, Due proof has been made that publication of notice of the adoption
of said Resolution No. 843 was duly made and given as by law provided; and
WHEREAS, At the time and place fixed in said Resolution No. 843 for the
making and filing of a protest against the abandonment of said Special Improve-
ment District No. 256, and the abandonment of the maintenance of street parklngs
thereunder, to-wit, at the hour of 1:00 o'clock P.II[. on Wednesday, the 26th of
,Tune A.D., 1957, being a regular meeting ti~e of said City Commission, at the
Commission Chamber in the City Hall building of the City of Bozeman, no protests
were made or filed against the abandonment of said Special Improvement District I
No. 256 or against the abandonment of maintenance of street parkings thereunder.
NOW THEREFORE, BE 1'1' RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That said Special Improvement District No. 256 of the City of Bozeman, State
of Montana, and the ~aintenance of street parkings thereunder, be and the same is
hereby abandoned.
Section 2
It shall be the duty of the owners of property abutting said District to
maintain the same from and after the date of this Resolution and such abandonment
shall not relieve said property owners from the assessment and payment of a
sufficient amount to liquida te all charges exis ting against said District prior
to the date of abandonment.
Passed and adopted by the Commission of the City of Bozeman at a regular
session thereof held on the 26th day of June, 1957.
