COMMISSION RESOLUTION NO. 843
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO ABANDON CITY OF
BOZEMAN SPECIAL IMPROVEMENT DISTRICT NO. 256 AND TO ABANDON THE MAINTEN-
ANCE OF STREET PARKINGS THEREUNDER, A~ID DIRECTING THE CLERK OF THE CITY
COMMISSION TO GIVE NOTICE OF SUCH RESOLUTION, ALL l'lJRSUANT TO THE STATUTES
IN SlroH CASES MADE AND PRoVIDED.
WHEREAS, A Petition was filed with the City of Bozeman on June 4, 1957, .1
by owners of property in Bpecial Improvement District No. 256 of the City of
Bozeman, praying for the abandonment of said District, and
WHEREAS, it appears for the best interests of the city of Bozeman and the
propert;.' owners within said Special Improvement District No. 256 tbat said
District be abandoned.
NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
SECTION 1. DECLARATION OF INTENTION. It is hereby declared to be the
intention of the City Commission of the City of Bozeman, Montana, to abandon
Special Improvement District No. 256 of said City and to abandon the maintenance
of any street parking improvements therein.
SECTION 2. BOUNDARIES OF DISTRICT. The 'boundaries of said Special Improve-
ment District No. 256 are as follows:
Beginning a t a point in the south line of Cleveland Street,said point
being 75 feet east of the east line of Sixth Avenue; thence south
parallel with and 75 feet east of the said east line of Sixth Avenue
to a point 28 feet south of the south line of Garfield Street; thence "I
west parallel with and 28 feet south of the said south line of Garfield
Street, as originally platted, to a point 75 feet west of the west line
of said Sixth Avenue; thence north parallel with and 75 feet west of the
said west line of Sixth Avenue to the south line of Cleveland Street;
thence east along said south line of Cleveland Street to the place of
beginning.
SECTION 3. BENEFITS DECLARED. It is hereby declared by the Commission of
the City of Bozeman that all of the land within the boundaries of said Special
Improvement District No. 256 will be specially benefited by such abandonment
and tha tit is to the bes t in teres ts of the Ci toy of Bozeman and the owners of
property witr.in the said District that the District be abandoned.
SECTION 4. EFFECTS OF ABANDONMENT. Should said Special Improvement
District No. 256 be abandoned in conformance to this Resolution and the Notice
to be published pursuant thereto, it shall be the duty of the owners of the
property abutting on the property involved to maintain the same after such
abandonment, and such abandonment shall not relieve said property owners from
the assessment and payment of a sufficient amoun t to liquids te all charges
existing against said District prior to the date of abandonment.
SECTION 5. TIME FOR PROTESTS. That the regular session of the City I
Commission of the City of Bozeman to be held at the Commission Chamber, City
Hall Building, Bozeman, Montana, on Wednesday, the 26th day of June A.D. 1957,
at the hour of 1:00 o'clock P.M. of said day, are the time and place when and
where the City Commission will hear and pass upon all protests duly and regularly
made and filed against the abandonment of said proposed Special Improvement
District No. 256.
SECTION 6. CLERK TO GIVE NOTICE. That the Clerk of the City Commission be,
and he is hereby directed to give notice in the manner and for the time as by

law required, of the adoption of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a stated
and regular session of said Commission held on the 12th day of June, A.D. 1957.

Notice is hereby given that on the 12th day of June, A.D. 1957, at a regular
meeting of the Commission of the City of Bozeman, Commission Resolution No. 843

That the boundaries of said Special Improvement District No. 256 are as
follows:
Beginning at a point in the south line of Cleveland Street, said
point being 75 feet east of the east line of Sixth Avenue; thence
south parallel with and 75 feet east of the said east line of Sixth
Avenue to a point 28 feet south of the south line of Garfield Street;
thence west parallel with and 28 feet south of the said south line of
Garfield Street, as originally platted to a polnt 75 feet west of the
west line of said Sixth Avenue; thence north parallel with and 75 feet
west of the said west line of Sixth Avenue to the south line of Cleveland
Street; thence east along said south line of Cleveland Street to the
place of beginning.
That Wednesday, the 26th day of June, A.D. 1957, at one o'clock P.M. at
the Commission Room of the City Hall, Bozeman, Montana, is the date, time and
place set for the hearing of protests against the abandonment of said Special
Improvement District No. 256 and for the passage of the Resolution of abandonment.
That unless forty (40) percent of the property owners of said Special
Improvement District No. 256 file written protest with the Clerk of the City
Commission before the above specified date and time, a Resolution of abandonment
I of said Special Improvement District No. 256 will be, by the City Commission,
passed.
That should said Special Improvereent District No. 256 be abandoned in
conformance to this Resolution and the Notice to be published pursuant thereto,
it shall be the duty of the owners of the property abutting on the property

This notice is given .pursuant to the provisions of Chapter 38 of the I
Laws of the 32nd Legislative Assembly, State of Montana.
