COMMISSION RESOLUTION NO. 840
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF' BOZEMAN, MONTANA, ABANDONING
CITY OF BOZEMAN SPECIAL DlPROVEMENT DISTRICT NO. 52 AND ABANDONING THE MAINTENANCE
OF STREET PARKINGS THEREUNDER, PURSUANT TO THE STATUTES IN SUCH CASES MADE AND
PROVIDED, AND PURSUANT TO AND IN CONFORMITY WITH COMMISSION RESOLUTION NO. 835 AS
PASSED AND ADOPTED BY SAID CITY COMMISSION ON THE 1st DAY OF MAY, A.D. 1957.
I WHEREAS, The City Commission of The City of Bozeman on the 1st day of May, A.D. 1957,
passed and adopted Commission Resolution No. 835 declaring it to be the intention of said
Commission to abandon City of Bozeman Special Improvement District No. 52 and to abandon
the maintenance of street parkings thereunder, which said Resolution, of record and on
file in the office of the Clerk of said City Commission and open to the inspection of the
public, 1s hereby referred to for further particulars, and
WHEREAS, Due proof has been made that publication of notice of the adoption of said
Resolution No. 835 was duly made and given as by law provided; and
WHEREAS, At the time and place fixed in said Resolu.tion No. 835 for the making and
filing of a protest against the abandonment of said Special Improvement District No. 52,
and the abandonment of the maintenance of street parkings thereunder, to-wit, a t the
hour of 1:00 o'clock P.M. on Wednesday, the 22nd day of May, A.D. 1957, being a regular
meeting time of said City Commission, at the Commission Chamber in the City Hall building
of The City of Bozeman, no protests were made or filed against the abandoment of said
Special Improvement District No. 52 or against the abandonment of maintenance of street
parkings thereunder.
I NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That said Special Improvement District No. 52 of the City of Bozeman, State of
Montana, and the maintenance of street parkings thereunder, be and the same is hereby
abandoned.
Section 2
It shall be the duty of the owners of property abutting said District to maintain
the same from and after the date of this Resolution and such abandonment shall not
relieve said property owners from the assessment and payment of a sufficient amount
to liquidate all charges existing ags.inst said District prior to the date of abandonment.
Passed and adopted by the Commission of the City of Bozeman at a regular session
thereof held on the 22nd day of May, 1957.
