SUBJECT: Shute Residence Renovations CUP/COA/DEV#Z-06111
MEETING DATE: Monday,July 10, 2006 at 6:00 PM; continued to.July 24, 2006.
BACKGROUND: This is a Conditional Use Permit (CUP) and Certificate of Appropriateness
(COA) application with deviations to allow the following alterations at 603 South Willson Avenue:
1) a rear deck/sunroom addition to the existing single-household residence, 2) demolition and/or
remodel of the existing detached garage to add a two-car garage on the ground floor and an
accessory dwelling unit on the 2nd-floor, 3) a new fence on the property and 4) related site
improvements. This application is a CUP because an accessory dwelling unit (AD-]) falls under a
conditional use in R 1 zoning.
Two deviations are requested with this application. The first is from Section 18.16.050, "Yards," to
allow the vehicle entrance in the detached garage to be closer than 20 feet to a property line, and the
second is from Section 18.38.060, "Yard and Height Encroachments,Limitations and Exceptions,"
to allow the detached garage to encroach into the required 15-foot corner side yard setback.
On Julv 10, 2006, the Commission acted on a motion to "Approve the Shute Residence
Renovations, Certificate of Appropriateness with deviations at the residence located at 603
South Willson Avenue, as conditioned by staff; with the following amendments:Add the phrase
"if' required by code" to the end of'the second sentence nf' condition 13., and with exclusion of
the CUP component•for ac•cessory dwelling " The motion_failed on a 2-2 vote. Per Section
2.04.050 BMC, the affirmative vote of'three Commissioners is needed to adopt or reject a
motion, so the item was continued to July 24, 2006, so that Mayor Krauss can cast a deciding
vote.
The applicant has provided additional written and graphic material for the Commission to
review prior to the meeting on the 241h. Mayor Krauss has indicated he will review the dvd
record of•theJuly IO'h meeting, as well as all packet material, to be in a position to break the tie
vote. If the motion on the table fails, there will be an opportunity for•a subsequent motion to be
made.
UNRESOLVED ISSUES: The Department of Planning is not aware of any unresolved issues for
the proposed development at this time.
RECOMMENDATION: That the City Commission approve the Shute Residence Renovations
CUP and COA application with deviations (#Z-06111) as conditioned by Planning Staff.

proposed development at this time.
