WHBR8AS, There bas been filed with the Clerk of the City Commission of the City of Bozeman, Montana, petitions in due form of certain owners of properties situated on West Koch Street from South Ei!1"hth Avenue to South Fifteenth Avenue on West Story Street and West Dickerson Street from South Eighth Avenue to South Fourteenth Avenue on West Alderson Street from South Ninth Avenue to South Fourteenth Avenue, on South Ninth Avenue from West Koch Street to West Dickerson Street, and on South Tenth, Eleventh, Twelfth, ThiDteenth and Fourteenth Avenues from West Koch Street to West College street, asking that a special improvement district be created for the pur- pose of constructin~ and installing a pavement project to include combination curbs and gutters, gravel base course, crushed gravel cusbion course, and bituminous sur- face course and other work incidental thereto; and I Wm~REAS, That at a re~ular meeting of the City Commission of the City of Bozeman held on the 15th day of May, 1957, the aforesaid petition was respectively considered and granted; NOW TIlliREFORE, B"" 1"1' RESOLV~D py THT'~ err" sm'MISSION OF THE CIT'{ OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a Speclal Improvement Dlstrlct to be known and designated as Special Improvement Distrlct No. 393 of the City of Bozeman for the purpose of constrvctlon and install- ing a pavement pro1ect on West Koch Street from South Eighth Avenue to South Fifteenth Avenue on West Story Street and West Dickerson Street from South Eighth Avenue to South Fourteenth Avenue, on West Alderson Street from South Ninth AVenue to South Fourteenth Avenue, on South Ninth Avenue from West Koch Street to West Dickerson Street, and on South Tenth, Eleventh, Twelfth, Thirteenth, and Fourteenth Avenues from West Koch Street to West Colle!2'e Street~ sald pavement pro.1ect to Incluae combina- tion curbs and gutters, gravel ('ase course, crushed gravel cushion course, and bi tum- I inous surface course and other work incldental th'~reto. Section 4 I Estimate of Cost The preliminary estimate of cost 1s $381,754.12 incllldinp: all street excavation, all materials, installation costs, engineering and incidentals. Sec tion 5 Method of Assessment The preliminary estimate of cost set forth above 1s to be assessed on an area basls, with .he first 25 feet of each lot next and ad1acent to the improvement being recorded at double its actual area in computin~ the a~sessable area of each lot. On this basis, the assessable area of the district is 2,911,663.54 square feet. Section 6 Actual Area of District The actual area of the district as described 1s 2,252,907.29 square feet, and protests will be considered on an actual area basis. Section 7 Payments I That payments for said 'mprovements shall be made in twenty (20) annual install- ments exten0ing over a period of nineteen (HJ) years, but this shall not be construed to prevent payment in f1.111 at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of tte constuction and installation of said improvements with cash to be obtained from the sale of bonds COMMISSION RESOLUTION NO. 839 1~{:1 of said Special Improvement District No. 393, as authorized by law. Such bonds will be in denomina tions of $,100.00 each and frac tions or multiples of $100.00 where nee- as aery, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 393 Fund of the City of Bozeman. The bonds will be I redeemable at the option of the City, singly or in multlplsE, and 1n the order of their regjstration, whenever funds are available for tbat purpose in said Special Improvement District No. 393. Said bonds shall draw a simple interest from the date of their registratjon lmtil called for payment, at a rate not exceeding six (6) per cent per annum, which 1nterest shall bc~ chargeable as a part of the cost of the con- struction and installation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to Special Improvement Districts in cities and towns, and any amendments thereof or thereto. That W3dnesday, the 19th day of June, A.D., 1957, at one o'clock P.M. at the Commission Room of the City Hall, Bozeman, Montana, is desi~nated by said Resolution No. 839 as the time and place for hearing objections to the action proposed to be taken by said resolution, and when and where any and all persons whose property is within saId propoeed Special Improvement Dlstrlct No. 393 on West Koch Street from South Eighth Avenue to South Fifteenth Avenue on West Story Street and West Dicker- son Street from Sovth Eighth Avenue to South Fourteenth Avenue, on West Alderson Street from South Nlnth Avenue to South Fourteenth Avenue, on South Ninth Avenue from West Koch Street to West Dickerson Street, and on South Tenth, Eleventh, Twelfth, Thirteenth ano Fourteenth Avenues from West Koch Street to West College Street, in said City, may appear and show cause, if any they have, ag,ainst sald proposed improve- ment. An approximate preliminary estimate of the cost of doin(~ such work and making suc~ improvement within said District, including all street excavation, all materials, installation costs, engineering and In~identals, which is to be specially assessed a?ainst the property within said District, is $381,754.12. Property immediately ad- ,1ncent to and within 25 feet of the proposed improvement 1s to be assessed at double the assessment agaln~t the other property in the District. Payment for the improve- ments is to be made in twenty (20) annual installments over a priod of nineteen (19) years witt, jnterest on the deferred payments not to exceed six (6) per cent per annum, payable annually, but this shall not be construed to prevent payment in full at any re~ular payment d8te by any property owner. For a description of the boundaries of said Special Improvement District No. 393 reference is hereby made to Fesolution No. 839 of the Commission of the City of Boze- man declaring the intention to create said District, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, I State of Montana, and open for inspection to all interested parties and the public generally.
