I WHEREAS, a Petition was filed with the City of BozemBn on April 24, 1957, by owners of propprt~ in Special Improvement 0istrict No. 52 of the City of Bozeman, praylrg for the abandonment of said District, and WHEREAS, it appears for the best interests of the City of Bozeman and the propert~T ownprs within said Special Impro'Tement District No. 52 that said District by abandoned. NOW THER5:PORE, BE IT RESOLVED BV THE COMMISSION OF THE CITY OF BOZENAN: Section 1 Declaration of IntF'ntion It 1s hereby 6eclared to be tr'e intention of the Ci ty Commission of the City of Bozeman, Montana, to abandon Special Improvement District No. 52 of said City and to abandon the maintenance of any street parking imporvements there in. Section 2 Boundaries of District The boundaries of said Special Improvement District No. 52 are as follows: I Beginning at a point in the center line of Babcock Street where the same is intersected by the center line of Fifth Avenue; thence running We~t to the intersection of the center line of said Babcock Street with a projection of the line between Lot~ 12 and 13 of Rouse's Third Addition; thence South along sairt Lot Line to a point 100 feet South of the South line ~f said Babcock Street; thence West to the center line of Eighth Avenue; thence North to a point IOU feet North of the North line of Babcock Street; thence East to the center line of Fifth Avenue; thence South to the place of beginnin~. Section 3 Benef,ts declared It is hereby declared by the Commission of the City of Bozeman that ~11 of the land within thB boundaries of said Special Improvement District No. 52 will be specially benefited by such abandonment and that it is to the best interests of the Cit~T of Bozeman and the owners of property with~n the said District thet the District be abandoned. Section 4 Effects of Abandonment Should said Special Improvement District No. 52 be abandoned 1n conform- ance to this Resolution and the Notice to be published pursuant thereto, it I shall b/3 the duty of the ownerS of the property abutt1ng on the property involved to majntaln the sa~e after such abandonment, and such abandonment shall not relieve said property owners from the assessment and payment of a sufficient amount to linuidate all ch8r~es existin~ a~a~nRt said District 11;-:- - .J prior to the date of abandonm8nt. Section 5 Time for Protests 1 That the reQ'uIar session of the City Corrmissio!1 of the City of Bozeman to be held at the Commission Chamber, City Hall Buj1ding, Bozeman, Montana, ()n Wedne ada y-, the 22nd day of May, A.D. 1957, at the hour of 1:00 o'clock P.M. of said day, are t!~e time and place when and where the C1 t~T Commission will hear and pass upon all protests duly and re,Q'1J.larly made and filed against the a~andonment of said proposed Special Improvement District No. 52. Section 6 Clerk to Give Notice That the Clerk of the City Commission be, and he is hereby directed to gjve notice in the manner and for the ti~e as by law reauired, of the adoption of this Pesolution of Intention. Improvement District No. 52 file written protest with the Clerk of the City Commission before the above speci~ied date and time, a Resolution of abaDdon- ment of said Special Improvement District No. 52 will be, by the City Commis- slon, passed. That should said Special Improvement District No. 52 be aandoned in con- formance to this 'Resolution and the Notice to be pub11shed pursuant thereto, it shall be the dtlty of the owners of the propHrty abutting on the property involved to maintain the same after such abandonment, And such abandonment shall not relieve sa1d property owners from the afsessment and payntent of a sufficient amount to l1au1dste all char~es existing a~ainst said District prior to the date of abandonment.
