827
A RESOLUTION OF THE CO~flMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLABING IT TO BE T}ill INTENTION OF SAID COMMISSION TO VACATE A
PORTION OF AN ALLEY IN BLOCK THREE (3) OF DURSTON'S SECOND ADDI-
TION TO THE CITY OF BOZEMAN, MONTANA
WHEREAS, Gallatin Cooperative Creamery, a corporation, claiming
to be the owner of
I property in Block Three ( 3) of Durston's Second Addition to the City of Bozeman,
Mon tana ,
has filed with the City Commission its petition for the vacation of a portion of an alley
in said Block Three (3 ) of Durston's Second Addition to the City of Bozeman, Montana,
and the City Commission having duly considered said petition and after such considera-
tion having determined that the prayer thereof may be granted without detriment to the
public interest and should be granted in the public interest;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1.
Declaration of Intention
It is hereby declared to be the intention of the Commission of the City of Bozeman
to vacate a portion of the alley in Block Three (3 ) of Durston's Second Addition to the
City of Bozeman, Montana, upon the petition of the Gallatin Cooperative Creamery, a corp-
oration, claiming to be the owner of property in Block Three (3)
of Durston's Second
Addition to the City of Bozeman, Montana, which said alley is more particularly describ-
ed as all that portion of the alley in Block Three (3 ) of Durston's Second Addition to
the City of Bozeman from the north line of Juniper Street to a point twenty (20) feet
I south of the north line of said Block Three ( 3) , as the
said Lot and Block are numbered
and designated and described upon the official plat and survey of said Addition now on
file and of record in the office of the County -Recorder in and for said County, subject
to objections of owners of property affected by such proposed vacation, in accordance
with the provisions of Section 11-3310 of the Revised Codes of Montana, 1947.
Section 2.
Time
for Objection
That the regular meeting of the Commission of the City of Bozeman to be held on
Wednesday, the 31st day of October, 1956, at the hour of one o'clock P.M. of said day,
is the time when the place where the City Commission will consider and pass upon objec-
tions to said proposed vacation and the City Manager is directed to give notice thereof
in the manner and for the time as provided in said Section 11-3310 of the Revised Codes
of Mon tana , 1947.
Passed and adopted by the City Commission at its regular meeting held on the 17th
day of October, 1956.

NOTICE IS HEREBY GIVEN: That the Commission of the City of Bozeman has adopted a
Resolution declaring it to be the intention of said Commission to pass an
Ordinance I
vacating a portion of the alley in Block Three (3 ) of Durston's Second Addition to the
City of Bozeman, Mon tana, in accordance with the petition of the Gallatin Cooperative
Creamery, a corporation, claiming to be the owner of property in Block Three (3 )
of
Durston's Second Addition to the City of Bozeman, Montana, which said alley is more
particularly described as all that portion of the alley in Block Three (3),
of Durston's
Addition to the City of Bozeman, from the north line of Juniper Street to a point twenty
(20) feet south of the north line of said Block Three ( 3 ) , as
said Lot and Block are
mlmbered and designated and described upon the official plat and survey of said Addi-
tion now on file and of record in the offioe of the County Recorder in and for Gallatin
County, the City Commission being of the opinion, after due consideration,
that said
petition may be granted without detriment to the public interest and should be granted
in the ptlblic interest.
And notice is hereby further given that any and all objections to the passage and
adoption of such an Ordinance of vacation will be heard and considered by the City Com-
mission at its regular meeting to be held on Wednesday, the 31st day of October, 1
956,
at the hour of one o'clock P.M. at the Commission Room in the City Hall Building,
