Home My WebLink AboutResolution 826 Taxes for Garbage, 1956 u______...."..___ --.-.-.-----. ~lt COMMISSION RESOLUTION NO. 826 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVY - ING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL REAL PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, SERVICED AND FROM WHICH GARBAGE WAS COLLECTED AND 'REMOVED DURING THE YEAR 1956, TO DEFRAY THE COST AND EXPENSE OF COLLECTING AND DIS}'OSING OF GARBAGE UNDER THE PROVISIONS OF ORDINANCE NO. 696 OF THE CITY OF BOZEMAN. WHEREA S , the City Commission of the City of Bozeman did on the 8th day of January, I 1940, duly and regularly pass Ordinance No. 696, entitled: AN ORDINANCE DEFINING GARBAGE FOR THE tJURPOSE OF THIS ORDINANCE, PROVID- ING FOR THE COLLECTION A~TD DISPOSITION THEREOF BY AND U~mE'R THE SUPERVI- SION AND CONTROL OF THE DRPA RTMENT OF PUBLIC VmLFAHE AND FOR DEFRAYING THE COST OF SUCH COLLECTION AND DISH)SITION BY SPECIAL ASSESS'MENT AGAINST THE PROPERTY TO WHICH SUCH SERVICE IS RENDERED, ANDf.'ROVIDnTG l'ENALTIES FOR VIOLATION OF THIS ORDINANCE, which Ordin9nce No. 696, passed as aforesaid is hereby referred to and made a part of this Resolution for further particulars in respect to the basis and method of assessing the cost against the property harein assessed, and WHEREA S , said expense incurred by said City in the collection and disposition of garbage in accordance with said Ordinance is hereby estimated by the Commission of the City of Bozeman to be the sum of Th1.rt:;r-two 'l'hotlSand Three Hundred Thirty Dollars and Forty-two Cents ($32,330.42) for the year 1956, over and above all moneys collected from business and professional concerns, or combined residence and business or residences and professional business concerns in accordance with said Ordinance No. 696, and WHEREAS, in order to raise said sum to defray the said cost, it is necessary to es- . tablish the basic unit rate as defined in said Ordinance No. 696 at Ten Dollars ($10.00) . I NOW, THE'REFO"'RE, pursuant to the provisions of said Ordinance No. 696, and the laws of the State,of Montana, BE IT HESOLVED AND IT IS HEREBY ORDERED BY 'T'BE COMMISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Section 1. That to defray the estimated cost and expense of collecting and dispos- ing of garbage in the City of Bozeman for the year 1956, there is hereby levied and assess- ed against the property and the severa I 10 ts, pieces and parcels of land thereof within the City of Bozeman as set forth in Schedule "A", which is attached hereto and made a part hereof, a tax; that a particular description of each lot and parcel of land which the name of the owner and/or owners and the sum assessed against the same is set forth in the assessment list in said Schedule "A"; that the several sums set opposite the names of said owners and the described lots and parcels of land, be, and the same are hereby levied and assessed upon and against said lots and parcels of land for said purpose; that the several sums be collected from the respective owners of said lots and parcels of land described in said assessment list and owned by them; tha t the said sums shall be paid and the collection thereof be made in the manner and in accordance with Ordinance No. 696 of the City of Boze~an, Montana, and the laws of the State of Montana governing I the collection of special improvement taxes; that failure to pay such assessment when the same sha 11 be come due and pa ya ble she 11 ma ke such persons and such lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Section 2. That the regular session of the Commission of the City of Bozeman, Montana, to be held in the Commission Chamber in the City Hall of said City on the 17th -. _____ ___nn_ - -------.-- ~-_.._--- 9;) day of October, 1956, at 1:00 o'clock P.M. be, and the same is hereby designated as the time and place at which objections to the final adoption of this Resolution will be heard by said Commission. Section 3. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper I printed and published in said City of Bozeman, a notice signed by the Clerk of the Commis- ~ sion, s ta ting tha t a resolution levying and assessing a special assessment of taxes to defray the cost and expense of the collection and disposition of garbage in the City of Bozeman for the year 1956, against the property to which such service was rendered, is on file in the office of the Clerk of the Commission subject to inspection for a period of five days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; and that said Notice shall be published at least five days before the date set by the Commission for hearing of objections and the final adoption of this Resolution. Provisionally passed and adopted by the Commission of the City of Bozeman at a re- gular session thereof held on the lOth day of October, 1956. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 10th day of October, 1956, Commission Resolution No. 826 was pro- visionally passed and adopted; that said Resolution levies and assesses a special assess- I ment of ta xes to defray the cost of collection and disposition of garbage in the City of Bozeman', for the year 1956, upon all property to which such service was rende red. That said Commission Resolution No. 826 is now on file in the office of the Clerk of the Commission of the City of Bozeman, subject to inspection of all persons interested, for a period of five days; that Wednesday the 17th day of October, 1956, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, in the .~ Resobltion No. 826 -.,,-..,.-- ---.-..-.,.. __n.'.
