N COMMISSION RESOLUTION NO. 825 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESS- ING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST OF EX- TE'RMINATION AND REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1956 PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 428 ENTITLED: "AN ORDINANCE DEFINING AND PRO- VIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES." WHEPEAS, the City Council of the City of Bozeman heretofore duly and regularly I passed Ordinance No. 428, entitled: "AN ORDINANCE DEFINING AND PROVIDING FOR THE PUNISHMENT AND ABATEMENT OF CERTAIN NUISANCES", and WHEREAS, Section 11-985 R.C.M. 1947, provides the City or Town Council has power to declare and determine what vegetation within the City or Town shall be noxious weeds, and to provide the manner in which they shall be exterminated, and to require the owner or owners of any property within said City or Town, to exterminate or remove noxious weeds from their premises, and one-half of any road or street lying next to the lands or boule- vard abutting thereon, and to provide, in the event the owners or owner of any of said premises neglect to exterminate or remove noxious weeds therefrom, for levying the cost of such extermination or removal as special assessment against the property; and WHE'REA S , owners of premises in said City have neglected to exterminate and remove noxious weeds therefrom during the year 1956 and the City of Bozeman, pursuant to Sec- tion 11-985 R.C.M. 1947, and Ordinance No. 428, have exterminated and removed noxious weeds from the premises of said owners and the total cost of the extermination and re- moval thereof is chargeable to the property as hereinafter set forth, pursuan t to the provisions of said Section 11-985, Political Code, R.C.M. 1947 , and said Ordinance No. I 428; BE IT RESOLVED AND IT HBREBY ORDERED BY THE COMMISSION OF THE CITY OF BOZEMAN, STA~E OF MONTANA: Section 1. That during the year 1956, the City of Bozeman has exterminated and re- moved noxious weeds from properties in the City of Bozeman and defrayed the cost thereof as set forth in Schedule hereto attached and made a part hereof. See tion 2. That to defray the cost ($97.75) of exterminating and removing said noxious weeds from said premises as set forth in said schedule, hereto attached and made a part hereof, for the year 1956, there be, and there is hereby levied and assessed a special tax against said property as set forth in said schedule, hereto attached and made a part hereof; that a particular description of each lot and parcel of land wi th the name of the owner and the sum assessed against him or it is set forth in assessment list hereto attached marked "Schedule One", and made a part hereof; that the several sums set opposite the names of the owners and the description of the lots and parcels of land be, and the same are hereby levied and assessed upon and against said lots and parcels of land; tha t the several sums be collected from the respective owners of said I lots and parcels of land described in said assessment list, "Schedule One", as required by law; that said sums shall be paid and the collection thereof shall be made in the manner in accordance wi th the law governing the collec tion of specia 1 lmprovemen t taxes; that failure to pay such assessments when same shall become due and payable shall make such persons and such lots and parcels of land liable to the penalties provided by law _.- relative to de11nquent taxes. That the regular session of the Commission of the City of Bozeman to be held on the 17th day of October, 1956, at the Commission Room, City Hall Building, be and the same is hereby designated as the time and place at which objections to the final adop- tion of this Resolution will be heard by the Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and direct- I ed to publish in the Bozeman Daily Ghronicle, a daily newspaper printed and published in the said City of Bozeman notice signed by the Clerk of the Commission, stating that a re- solution levying a special assessment of taxes to defray the cost of exterminating and removing noxious weeds from certain properties in the City of Bozeman for the year 1956, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five days; that said notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; tha tit shall be published at least five days before the date set by the Commission for hearing of objections, and the final adoption of this resolution. Provisionally passed by the Commission of the City of Bozeman' at a regular session thereof held on the lOth day of October, 1956. NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of Bozeman held on the 10th day of October, 1956 Commission Resolution No. 825 was duly pass- ed and adopted; that said Commission Resolution No. 825 levies and assesses a special assessment of taxes upon certain properties in the City of Bozeman for the year 1956 to defray the cost of exterminating and removing noxious weeds for the year 1956. That, said Commission Resolution No. 825 is now on file in the office of the Clerk of the Commission of said City of Bozeman subject to inspection of all persons interested for a period of five days; that Wednesday the 17th day of October, 1956, at 1:00 o'clock P.M., of said day at a regular session of the Commission of the City of Bozeman, City Hall Build- ing, has been designated as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission Resolution No. 825 and the levying of said assessment; that, said Resolution I will be finally passed and adopted at said regular session of said Commission subject to such corrections and amendments as may be made upon objections made and filed within the five days limit as provided by law.
