COMMISSION RESOLUTION NO. 824
A RESOLUTION OF THE COM1IfISSION OF THE CITY OF BOZEMAN LEVYING AND
ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN
THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DE-
FRAY THE COST OF CONSTRUCTING AND INSTALLING AND/OR REPAIRING MIS-
CELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1956.
I WHEREAS, the Commission of the City of Bozeman, pursuant to the provisions of
Ordinance No. 561, entitled:
"AN ORDINANCE GOVERNING THE CONSTRUCTION AND INSTALLA TI ON OF CON-
CRETE CURBS AND SIDEWALKS IN THE CITY OF BOZEMAN, PROVIDING PENAL-
TIES FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ORDINANCES
N,OS. 365, 374, 425, 447, 449, AND 451, AND ALL OTHER ORDINANCES
AND PARTS OF' ORDINANCES OF THE CITY OF BOZEMAN IN CONFLICT HERE-
WITH",
and the provisions of Section 11-2226, Political Code, R.C.M. 1947, provided for the
construction of sidewalks and curbs in the City of Bozeman during the year 1956, with-
out the formation of a Special Improvement District;
WHEREAS, proceedings were had for the construction and installation and/or repair
of Miscellaneous Sidewalks and Curbs in the City of Bozeman for the year 1956, and
WHEREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or
repaired bordering on various properties in the City of Bozeman, pursuant to Ordinance
No. 561, Section 11-2226, Political Code, R.C.M., 1947, which are hereby referred to
and made a part of this Resolution, and
WHEREAS, the said Miscellaneous Sidewalks and Curbs have been constructed and
completed and/or repaired in accordance with the terms and conditions of said proceed-
I ings, and the City Engineer has duly certified to the Commission a Schedule showing the
sidewalks and Curbs which have been constructed and installed and/or repaired, and the
properties which are subject to assessment thereunder and the total cost of said con-
struction and installation and/or repairing is the sum of Sixteen Hundred Twenty-two
and 07/100 Dollars ($1622.07) which Schedule, marked Schedule "A", is hereto attached
and made a part hereof.
NOW, Till1;11EFORE, Pursuant to the provisions of Ordinance No. 561 as aforesaid, and
Section 11-2226, Political Code, R.C.M. 1947, as aforesaid,
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE
CITY OF BOZEMAN, MONTANA:
Section 1. That to defray the cost of constructing and installing and/or repair-
ing Miscellaneous Sidewalks and Curbs as set forth in Schedule "A", hereto attached and
made a part hereof, there is hereby levied and assessed a tax amounting to the sum of
Sixteen Hundred Twenty-two Dollars and Seven Cents, ($1,622.07).
Section 2. That a particular description of each lot and parcel of land with the
name of the owner and the sum assessed against him or it for such construction and in-
) stallation and/or repair and the amount of each payment to be made and the day when the
same shall become delinquent is set forth in the assessment list hereto attached marked
Schedule "A" and made a part hereof; that the several sums set opposite the name of the
owner and the description of the lots and parcels of land be, and the same are hereby
respectively levied and assessed upon said lots and parcels of land to defray the cost
and expense of constructing and installing and/or repairing said Sidewalks and Curbs;

that the several sums so assessed be collected from the respective owners of said lots
and parcels of land described in said assessment list as required by law; tha t the pay-
ment of saId sums shall be made in six installments; that the payment of said install-
ments shall be made on or before the 30th day of November of each year until payment of
all installments together with the interest thereon, shall be made; too t said sumS shall
be paid and the collec tion thereof sha 11 be made in the manner and in accordance wi th I
the law governing the collection of Special Improvement taxes; that failure to pay such
assessmet1. ts when the same shall become due and payable sha 11 make such persons and said
lots and parcels of land liable to the penalties provided by law relative to delinquent
taxes;
Section 3.. That the regular session of the Commission of the City of Bozeman to be
held in the Commission Chamber in the City Hall of said City on the 17th day of October,
1956, at 1:00 o'clock P.M.. be, and the same is hereby designated as the time and place
at which objections to the final adoption of this Resolution will be heard by said Commis-
sion.
Section 4.. That the Clerk of the Commission of the City of Bozeman be, and he is
hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper
printed and published in the said City of Bozeman, a notice signed by the Clerk of the
Commission and stating that a Resolution levying and assessing a special assessment of
taxes to defray the cost and expense of constructing and installing and/or repairing
Sidewalks and Curbs in the Ci ty of Bozeman for the year 1956 is on file in the office of
the Clerk of the Commission subject to inspection for a period of five (5) days; tha. t

sa.id Notice shall state the time and place at which objections will be heard by the Commis-
sion to the final adoption of this Resolution; that it shall be published at least five
( 5) days before the date set by the Commission for the hearing of objections and the
final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a re-
gular session thereof, held on the lOth day of October, 1956..

MENT TAXES, CONSTRUCTION AND INSTALLATION AND/OR REPAIR MISCELLANEOUS
SIDEWALKS AND CURBS IN THE CITY OF BOZEMAN DURING THE YEAR 1956..
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of the City of
Bozeman held on Wednesday, the 10th day of October, 1956, Commission Resolution No. 824
was provisionally passed and adopted; that said Commission Resolution levies and assesses
a special assessment of taxes upon certain lots and parcels of land in front, or on the

side of which, s idewa 1ks and curbs have been constructed and/or repaired pursuant
to
the provisions of Ordinance No. 561 and Section 11-2226,
