Work Force Housing Agreement
Dear Manager Kukulski:
As per the recommendation of the Community Affordable Housing Advisory Board on January
8, 2014, and as stipulated in the CAHAB minutes of that meeting, I agree to allow the Bozeman
HRDC a 90 -day pre -sale opportunity to identify qualified low and moderate income purchasers
for the HRDC Road to Home program. The 90 -day pre -sale period would begin at the time of
filing of the final plat for the Norton East Ranch Phase 2A Subdivision and lapse at the close of
the work day, 5PM, 90 calendar days thereafter. If during the 90 -day pre -sale period a qualified
purchaser cannot be found for a given home, the home will be released for sale to whomever I

Regarding: Norton East Ranch Subdivision, Phase 2A lot size waiver request
Dear Commissioners and Mayor Krauss:
Following an affirmative recommendation by the Community Affordable Housing Board
(CAHAB) on January 8, 2014, and on behalf of the Norton East Ranch Subdivision owners, we
are submitting this lot size waiver request for a portion of the Norton Phase 2A Subdivision.
By way of background information, the Norton Subdivision was given preliminary plat approval
on January 22, 2008. It was approved for up to 322 dwelling units with a variety of lot sizes,
including smaller than standard lots targeted to provide workforce housing. Since the original
approval, two portions of the subdivision, providing for 143 dwelling units, have been given final
plat approval. This phase, Phase 2A, would provide lots for an additional 46 dwelling units,
including 18 smaller single family lots, which are the subject of this waiver request.
The workforce housing standards that were in place at the time of the 2008 subdivision approval
have been suspended. In the 2008 approval, nine narrower (33 -feet wide vs 50 -feet) than
typical lots were approved, to help address workforce housing requirements. Since then, the
project owner, Kevin Spencer, has found a suitable house design and market for these small
lots and wishes to submit a final plat that will create 18 more.
The owner is requesting your approval to file another final plat, within the original Norton East
Ranch subdivision boundary, that would create 18 more of the narrower, single family workforce
housing lots. In addition, the owner is requesting a waiver to the income and price restrictions
normally applied to Work Force Housing, as were originally stated in Section 10 of the UDC.
However, the owner would honor the request by the HRDC in the January 8 CAHAB meeting to
give HRDC a 90 -day pre -sale opportunity to find qualified low to moderate income purchasers.
Attached is a draft final plat showing the location of the additional 18 Work Force Housing lots
proposed by Mr. Spencer, copies of the CAHAB recommendation and January 8 meeting
minutes and an agreement between Mr. Spencer and the City of Bozeman on behalf of HRDC.
