COMMISSION RESOLUTION NO. 821
A RESOLUTION OF THE COr.':MISSION OF THE CITY OF BOZEMAN, MONTANA,
LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON ALL THE
PROPERTY IN SPECIAL IMPROVEMENT DISTRICT NO. 383 IN THE CITY OF
BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DEFRAY THE COST
OF CONSTRUCTING AND MAKING THE IMPROVEMENTS WITHIN SAID SPECIAL

I WHEREAS, The City Commission of The City of Bozeman, did on the 15th day of June,
1955, duly and regularly pass Commission Resolution No. 789, entitled:
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPEC-
IAL IMPROVEMENT DISTRICT OF SAID CITY TO BE KNOWN AND DESIGNATED AS
"SPECIAL IMPROVEMENT DISTRICT NO. 383 OF THE CITY OF BOZEMAN" FOR THE
PURPOSE OF CONSTRUCTING AND INSTALLING A SIX INCH WATER MAIN ON WEST
MA IN STREET FROM NINTH A VENUE TO ELEVENTH A VENUE, A TEN INCH WATER
MAIN ON NORTH ELEVENTH AVENtm FROM MAIN STREET TO A POINT FORTY FEET
NORTH OF MENDENHALL STREET, A SIX INCH WATER MAIN ON WEST MENDENHALL
STREET FROM ELEVENTH A VENUE TO SEVENTH A VENUE, AND A FOUR INCH -WATER
MAIN ON NORTH TENTH AVENUE FROM MAIN STREET TO MENDENHALL STREET, AND
TO SPECIALLY ASSESS A CERTAIN PORTION OF THE COST OF SUCH CONSTRUCTION
AND INSTALLATION AGAINST THE PROPERTY WITHIN THE BOUNDARIES OF SAID
SPECIAL IMPROVEMENT DISTRICT SO CREATED ON AN AREA BASIS, PURSUANT TO
THE STATUTES IN SUCH CASES MADE AND PROVIDED,
and thereafter, after due and legal proceedings had, the Commission of The City of
Bozeman did on the 13th day of July, 1955, duly pass Commission Resolution No. 790, en-
ti tled:

A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT
DISTRICT NUMBER 383 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CON-
STRUCTING A SIX INCH WATER MAIN ON WEST MAIN STREET FROM NORTH NINTH
A VENUE TO ELEVENTH A VENUE, A TEN INCH WATER MAIN ON NORTH ELEVENTH
AVENUE FROM MAIN STREET TO A POINT FORTY FEET NORTH OF THE NORTH
I PROPERTY LINE OF WEST MENDENHALL STREET, A SIX INCH WATER MAIN ON
WEST MENDENHALL STREET FROM ELEVENTH AVENUE TO SEVENTH AVENUE, AND
A FOUR INCH WATER MAIN ON NORTH TENTH AVENUE FROM MAIN STREET TO
MENDENHALL STREET,
which Commission Resolutions nos. 789 and 790, passed as aforesaid, are hereby referred
to and made a part of this resolution for further particulars in respect to the boundar-
ies of said district, the character of the improvements to be constructed therein, the
estimated cost of said improvements and the method of assessing the cost against the
property within said district; and
WHEREAS, said improvements as contemplated in said Commission Resolutions Nos. 789
and 790 have been constructed and completed in accordance with the terms and conditions
of Commission Resolutions Nos. 789 and 790, and the total cost of said improvements so
constructed is the sum of Three Thousand Eight Hundred and nO/lOa Dollars ($3,800.00).
NOW, THEREFORE, pursuant to the provisions of Sections 5225 to 5277.5 and 5485,
R. C. M., 1935 and amendments thereto,
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE
CITY OF BOZEMAN, STATE OF MONTANA:
Section 1. That to defray the cost and expense of constructing and making the
I improvements in said Special Improvement District No. 383, there be, and there 1s here-
by levied and assessed a tax amounting to the sum of Three Thousand Eight Hundred Dollars
($3,800.00) upon all the property in said Special Improvement District No. 383, that a
particular description of each lot and parcel of land with the name of the owner and the
sum assessed against him or it for such improvements and the amount of each partial pay-
ment to be made and the day when the same shall be delinquent is set forth in detail in
- the assessment list hereto attached, marked Schedule "A", and made a part hereof; that

the several sums set opposite the names of the owners and the described lots and par-
cels of land be, and the same are hereby respectively levied and assessed upon and
against said described lots and parcels of land to defray the cost and expense of
constructing and making the improvements within said District; that the several sums
so assessed be collected from the respective owners of said lots and parcels of land
described in said assessment list, Schedule "Aft, as required by law; that the payment I
of said sums shall be made in ten installments and the payment of said installments
shall extend over a period of nine years; that the payment of the respective annual
installments shall be made on or before the 30th day of November of each year until
payment of all installments together with the interest thereon, shall be made; that
said sums shall be paid and the collection thereof shall be made in the manner and in
accordance with the law governing the collection of special improvement taxes; that
failure to pay such assessments when the same become due and payable shall make such
persons and said lots and parcels of land liable to the penalties provided by law re-
la ti ve to de linquen t taxe s .
Section 2. That the regular session of the Commission of The City of Bozeman to
be held in the Commission Chamber in the City Hall of said City on the 26th day of
September, 1956, at 1:00 o'clock P.M., be, and the same is hereby designated as the
time and place at which objections to the final adoption of this Resolution will be
heard by said Commission.
Section 3. That the Clerk of the Commission of The City of Bozeman be, and he is
hereby ordered and directed to publish in the Bozeman Daily ~hronicle, a daily news- I
paper printed and published in the said City of Bozeman, a notice signed by the Clerk
of the Commission and stating that a Resolution levying and assessing a special assess-
ment of taxes to defray the cost and expense of constructing and making the improvements
in the said Special Improvement District No. 383 is on file in the office of the Clerk
of the Commission subject to inspection for a period of five (5) days; that said Notice
shall state the time and place at which ob.1ections will be heard by the Commission to
the final adoption of this Resolution, that it shall be published at least five (5) days
before the day set by the Commission for the hearing of ob,1ections and the final adoption
of this Resolution.
Provisionally passed and adopted by the Commission of The City of Bozeman at a re-
gular session thereof held on the 19th day of September, 1956.

HEARING, FINAL ADOPTION OF COMMISSION RESOLUTION 821, LEVY-
ING ASSESSMENT SPECIAL IMPROVEMENT DISTRICT NO. 383, CITY OF
BOZEMAN, WATER MAIN ON WEST MAIN STREET FROM NINTH TO ELEVENTH;
ON ELEVENTH FROM MAIN TO MENDENHALL; AND ON MENDENHALL FROM
ELEVENTH TO SEVENTH A VENUE IN SAID CITY.
NOTICE IS HEREBY GIVEN, that at a regular session of the Commission of The City of
I Bozeman held on the 19th day of September, 1956, Commission Resolution No. 821 was pro-
visionally passed and adopted; that said Commission Resolution levies and assesses a
special assessment of taxes upon all the property in Special Improvement District No.
383 in said City, to defray the cost and expense of constructing and making the improve-
ments within said District, to-wit:
BEGINNING at the Southeast Corner of Block Three (3) of the
Springbrook Addition to the City of Bozeman, Montana, thence
Northerly along the West Line of North Ninth Avenue to a point
on the center iine of the East and West Alley in s aid Block
Three (3); thence Westerly along the said center line of the
East and West Alley to a point on the center line of the North
and South Alley of said Block Three (3); thence Northerly along
the said center line of the North and South Alley to a point on
the South Line of West Mendenhall Street; thence Westerly along
the said South Line to a point of intersection with the center
line produced of the alley in Block Five (5) of said Springbrook
Addition; thence Northerly along said center line of alley produc-
ed and said center line of alley of Block Five (5) to a point of
intersection with the North Line produced of Lot Fourteen (14),
of said Block Five (5); thence Westerly along said North Line
produced and the North Line of said Lot Fourteen (14) to a point
on the West City Limits of the City of Bozeman; thence Southerly
along the said West City Limits to a point on the East and West
center line of Block "H" of Story's Addition to the City of
Bozeman; thence Easterly along the East and West center line of
said Block "H", said East and West center line produced of Block
I "H", and the East and West center line of Block "G" of said Story's
Addition, to a point on the West Line of South Ninth Avenue; thence
Northerly along the said West Line of South Ninth Avenue and said
West Line produced of South Ninth Avenue, to a point on the North
. Line of West Main Street; thence Easterly along the North Line of
West Main Street to the point of beginning.
That, said Commission Resolution No. 821 is now on file in the office of the Clerk
of the Commission, subject to inspection for a period of five (5) days by any persons
interested. That Wednesday, the 26th day of September, 1956, at 1:00 o'clock P.M., of
said day at the regular session of the said Commission of The City of Bozeman, at the
Commission Room, in the City Hall Building of said City, has been designated as the
time and place when and where said Commission will hear and pass UpOh any and all objec-
tions that may be made to the final passage and adoption of said Resolution No. 821, and
the levying of said assessment, and that said Resolution will be finally passed and
adopted at said regular session.
All persons interested are referred to Commission Resolution No. 789, declaring it
to be the intention of the Commission to create Special Improvement District No. 383,
and Commission Resolution No. 790, creating Special Improvement District No. 383, for
constructing and making the improvements therein.
