HomeMy WebLinkAboutResolution 818 Assessing Lighting Districts 72 COMMISSION RESOLUTION NO. 818 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AND ASSESSING LIGHTING DISTRICT MAINTENANCE AND ELECTRICAL CURRENT COSTS FOR SPECIAL IMPROVEMENT LIGHTING DISTRICTS NU1I13ERS 361, 362, 284, 288, 290, 295 AND 300 OF THE CITY OF BOZEMAN, PURSUANT TO THE PROVISIONS OF SECTIONS 11-2252 R. C. M. 1947. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN. Section 1. That pursuant to the direction and by authority of the provisions of I Section 11-2252, R.C.M., 1947, and upon estimates of such cost made by said City Commis- sion as authorized and directed by said Section 11-2252, R.C.M., 1947, to defray the cost of maintaining lighting systems and for electrical current in the several Special Improvement Lighting Districts of the City of Bozeman hereinafter specified, there is hereby levied and assessed against property and the several lots, pieces and parcels thereof, within the boundaries of Special Improvement Lighting Districts Nos. 361, 362, 284, 288, 289, 290, 295, and 300 of the City of Bozeman respectively, as heretofore created and established, the total amounts as to each entire district and the several amounts as to each lot, piece, or parcel of land within the boundaries of such district, as set forth, in the several schedules attached hereto and made a part hereof and marked separately for identification as Schedule A, for SILD No. 361 (Main Street); Schedule B for SILD No. 362 (W. Ma in St.); Schedule C for SILD No. 284 (Cleveland St.); Schedule D for SILD No. 288 (So. Tracy Ave.), Schedule E for SILD No. 289 (No. Bozeman Ave.); Schedule F for SILD No. 290 (So. Black Ave.); Schedule G for SILD No. 295 (So. Willson Ave.); Schedule H for SILD No. 300 (No. Willson Ave.). The amount so levied and assessed is 75% of such estimated cost for each and all I of said Districts except for SILD's Nos. 361 and 362, and as to such districts the levy and assessment is 50% of such estimated cost. Section 2. That a particular description of each lot, piece or parcel of land with the name of the owner thereof, and the sum assessed and levied against such property and owner, or either, is set forth in the schedule of each district as specified and identi- fied in Section 1 of this Resolution, and made a part of this Resolution as aforesaid. Section 3. That the regular meeting of the Commission of the City of Bozeman to be held on the 19th day of September, 1956, at 1:00 o'clock P.M. at the Commission Chamb- er, City Hall Building, in the City of Bozeman, be, and the same is hereby designated as the time and place at which objections to the final adoption of this Fesolution will be heard and considered by said City Commission. Section 4. That the Clerk of the Commission be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper of general circula- tion printed and published in 8 aid Ci ty of Bozeman, a notice sip;ned by said Clerk as such, which notice shall state that this Resolution levying and assessing the several amoun ts I set forth in the Schedule attached hereto and made a part hereof as aforesaid, and for the purposes herein stated, has been provisionally passed and adopted by the Commission of the City of Bozeman and is on file in the office of said Clerk and subject to inspec- tion during regular office hours, for a period of five days from and after the publica- tion of such notice and at any tirre during such office hours and at or prior to the re- gular meeting of the City Commission to be held on the 19th day of September, 1956, as ___"___n._ ...- .. --.-. ....---- .- 73 stated in Section 3 hereof; that said Notice shall be so published once, and such publi- cation shall be made not less than five days before the time set for hearing and con- sidering objections to the final adoption of this Resolution as aforesaid. NOTICE IS HEREBY GIVEN, that at a regular meeting of the Commission of the City of I Bozeman, Montana, held on the 12th day of September, 1956, Commission Resolution No. 818, was provisionally passed and adopted. Said Resolution levies and assesses a special assessment upon all the property in Special Improvement Lighting Districts Nos. 361 (E. Main St.); 362 (W. Main St.); 284 (Cleveland St.); 288 (So. Tracy Ave.); 289 (No. Bozeman Ave.); 290 (So. Black Ave.); 295 (So. Willson Ave.); and 300 (No. Willson Ave.), to defray the estimated cost of maintenance and electrical current for each of said Districts, pursuant to the provisions of Section 11-2252, R.C.M. 1947. The portion of such cost assessed is 75% as to all of said Districts except Districts No. 361 and 362 (Main St.) and as to such districts the portion of the cost assessed is 50%. NOTICE IS FURTHERGIVEN, That said Commission Resolution No. 818 is now on file in the office of the Clerk of the Commission, City Hall, Bozeman, Montana, and subject to inspection of all persons interested for a period of five days; that Wednesday, the 19 th day of September, 1956, at 1:00 o'clock P.M. of said day at a regular session of the Commission of the City of Bozeman, Commission Room, City Hall Building, has been designat- ed as the time and place when and where said Commission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Commission 'I Resolution No. 818. Reference is me de to Commission Resolutions Nos. 677,678,214,284, 285, 286, 305, and 316 creating the Special Improvement Lighting Districts above enumer- ated, which resolutions are on file in the office of said Clerk, subject to public inspec- tion during regular office hours.
